On April 27, 2023, Licensing Program Analysts (LPA's) Lorena Valenzuela and Jeanette Sanchez conducted an unannounced complaint inspection with The Children’s Place Child Development Center, LPA’s met with Director America Figueroa. The purpose of the inspection was to initiate an investigation and to deliver the findings on the above stated allegation. During this inspection, LPA's toured facility, took census, verified facility staff, and interviewed the Staff #1, Staff #2, Staff #3, Staff #4, one child, and Director. In addition, LPA's collected copies of pertinent facility documents. Additionally, as part of the investigation, LPA Valenzuela conducted interviews with other relevant parties.
On April 18, 2023, Community Care Licensing (CCL) received information facility staff spoke inappropriately to a daycare child while in care. It was reported that Staff #1 (S1) spoke inappropriately to Child #1 (C1) after food was spilled on the floor. It was also reported Staff #1 made derogatory remarks to Child #1 and made a threat to physically harm Child #1 (C1).

Confidential interviews revealed Staff #1 spoke inappropriately to C1. Interviews conducted revealed that after food was spilled on the floor by C1, S1 was speaking to C1 and referred to C1 by making derogatory remarks in regard to C1’s mother. Interviews conducted revealed, S1 made a verbal threat to choke C1.
LPA Valenzuela also conducted a review of a video with audio that was taken inside the facility classroom; the video is date stamp 04/11/2023. In the video, LPA Valenzuela observed Staff #1 (S1) speaking to Child #1 (C1) inappropriately. Video observations corroborated S1 is observed stating S1 was going to “choke” C1.
Based on interviews, video observations and records review, the preponderance of evidence standard has been met, and the allegation the facility Staff #1 (S1) spoke inappropriately to a daycare Child #1 (C1) while in care, is SUBSTANTIATED. The facility is being cited under Title 22, Section 101223 (a) (3) Personal Rights. See deficiency report, LIC 9099-D for citation cited.

LPA Valenzuela informed licensee/Director America Figueroa that this report dated 04/27/2023 document(s) (1) Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Valenzuela informed the licensee/Director America Figueroa to provide a copy of this licensing report dated 04/27/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

An exit interview was conducted, and report was reviewed with Director America Figueroa, and a copy of this report, LIC 9099-D, and appeal rights was provided to the Director America Figueroa. A Notice of Site Visit was issued and posted.

Director agrees to provide training from an outside organization, to all staff , the training will cover subjects such as communicating with children effectively. Licensee agrees to provide the Department with update within one day (due 04/28/2023), and follow up with documentation to the Department once training is completed.

This requirement is not met as evidenced by: Based on interviews, video observations, and records review, the facility did not ensure Child #1’s personal rights due to Staff #1 spoke inappropriately to Child #1 by threatening to choke Child #1 on at least one occasion. This poses an immediate health, safety or personal rights risk to the children in care.
