On the above date and time, Licensing Program Analyst (LPA) Susan Brewer, made an unannounced visit to the facility for the purpose of continuing a complaint investigation and to deliver findings, in regard to the above allegation. The LPA was greeted and granted entry into the facility by the licensees Rosa Gutierrez and Roman Gomez, to tour the facility inside and out. The LPA took a census of 6 children present, 1 staff, 1 adult resident and 1 other adult.

On 01/21/2025 the LPA Susan Brewer met with the licensees Rosa Gutierrez and Roman Gomez, to initiate the investigation regarding a Personal Rights allegation. During the investigation, the LPA made observations, reviewed and obtained facility records pertinent to the allegation. The LPA informed licensees more time was needed to complete the investigation and conduct interviews with pertinent parties. On today’s date, the LPA made observations, reviewed facility records and conducted interviews relevant to the investigation.

It was alleged that the licensed provider cut a child's hair without parents' permission. The LPA conducted observations, gathered records, and conducted interviews. LPA interview conducted with the reporting party allege that on or about 01/07/2024 a subject child was sent home from daycare with their hair looking shorter or as though it was cut while in daycare. Additional interviews conducted with pertinent parties denied the licensee and/or other staff cut a subject child’s hair. Other pertinent parties described a subject child getting paint in their hair during an indoor activity and as a result the licensee combed the child’s hair with water to remove the paint. Pertinent parties stated the licensee notified the subject child’s authorized representative upon pick-up, regarding the child’s hair being combed and de-tangled while in care.

During the investigation, the LPA reviewed photos and videos which included the supplies used during the indoor activity with daycare children on 01/07/2025. The LPA inspected the supplies observed in photos during the activities and determined the supplies to be non-hazardous to children and water soluble. The LPA was unable to determine the length of the of the subject child’s hair from photos taken before, during and after the indoor activity. Therefore, based on conflicting information gathered by observations, record review and interviews conducted, the allegation is determined to be Unsubstantiated.

Although the allegation that the licensee provider cut a child's hair without parents' permission may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

No violations were cited on today’s date.

No civil penalties were cited on today’s date.

Exit interview was conducted and a copy of this report was provided to the licensee's Rosa Gutierrez and Roman Gomez.

A notice of site visit was provided and must remain posted for 30 days.
