Gonzales attempted to interview other potential witnesses present during the incident and was unable to obtain statements to corroborate the allegation, due to the age range of children and general speech development being minimal and nonverbal. There was no video footage of the incident. Additional records reveiwed by the IB investigator, did not indicate a subject child's injury was a result of neglect or lack of care and supervision.
The investigation did not provide sufficient evidence to substantiate the allegation of Neglect/Lack of Care and Supervision. Based on the investigation, conflicting information gathered in interviews, record review and observation, the allegation was determined by IB Investigator J. Gonzalez to be Unsubstantiated.
Although the allegation that a day care child’s finger was severed due to lack of supervision may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
No deficiencies were issued on today's date.
No Civil Penalties were issued on today's date.
An exit interview was conducted with the director Christi Padilla, Appeal Rights were discussed and issued, a copy of this report was provided, and a Notice of Site visit was issued.
The Notice of Site Visit (LIC 9213) shall be posted where the parent/guardian of children enter and exit the facility. The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. |
