On date and time listed above, Licensing Program Analyst (LPA) Susan Brewer arrived at the facility to conduct an annual inspection and was granted entry by Licensee Sara Davis. LPA toured the facility, reviewed records, and observed and/or discussed the following: Present was the licensee and 1 resident minor. At 8:30 AM the licensee’s spouse Anthony Martinez arrived.

Normal days and hours of operation are: Monday – Friday, 7:00 AM to 5:30 PM.
OFF-LIMIT AREAS INCLUDE: Garage, Laundry Room, Entire 2nd Floor and Backyard.

The inspection consisted of reviews of the CARE tool domains. The inspection found the facility to be in compliance except as noted on the LIC809D. Deficiencies were cited this visit.
Licensee is present and is NOT operating within the licensed capacity with appropriate supervision and ratio. At the time of arrival, the LPA took a census of infant under the age of 2 and 5 children under the age of 5. At approximately 8:15 AM a 7th child under the age of 5 arrived. At 8:20 AM the census was 8 children in care, with 1 infant and 7 children under the age 5. The licensee’s spouse arrived at 8:30 AM to assist with care. At 8:33 AM the 9th child arrived to daycare. It was determined that the licensee operated out of ratio for approximately 15 minutes. The LPA took a census of 10 children in care prior to exiting the facility.
A working telephone and appropriate fire extinguisher are present.
Smoke and carbon monoxide detectors are present and were tested by the Licensee during this inspection.
All hazardous items are inaccessible to children. Storage of poisons/toxins are locked.
No fireplace or Fireplace is properly screened.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Stairs are properly barricaded on today’s date. Gate observed upon entry.
Facility is clean, orderly and has adequate heating and ventilation.
Facility has safe, age-appropriate toys for indoor. The outdoor area is off limits to daycare and the licensee stated they will take children to a nearby park.
Verification of control of property on file: Property owner/landlord notification and consent on file.
The following postings are visible: License, Emergency Disaster Plan (LIC610) and Earthquake Preparedness Checklist (LIC9148); Parent’s Rights Poster (PUB393); Personal Rights; Child Car Seat Law and facility sketch.

Documentation of fire & earthquake drills completed on 07/30 (year not indicated). The licensee stated they do not recall when they last conducted a fire drill.

Children/Infant records are NOT complete: The licensee did not have sleep logs available for 1 infant under 2 years of age. The licensee stated they infant does not nap. The licensee was provided regulations regarding Infant Safe Sleep. A child present in care did not have proof of the LIC700 Emergency Identification Card and did not have the LIC627 Emergency Consent form

Employee records are NOT complete: No qualified assistant present to assist while operating at a large capacity. A review of records indicated that the licensees’ spouse was pending a criminal record clearance as of 08/12/2025. During the inspection the licensee reached out to the Care Provider Management Bureau (CPMB), and a liaison was able to resolve the matter prior to the LPA leaving the home.
Guns or weapons are present as stated by the Licensee. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 regulations.

There are no bodies of water during this visit Licensee understands all bodies of water must be properly covered or fenced per Title 22 regulations. The Department must be notified before and after installation of the above types of water bodies. Licensee has/has not implemented required pool safety in accordance with PIN 25-01-CCP.

- AB 1207 – Mandated Child Abuse Reporting: Child Day Care Personnel Training, beginning January 1, 2018 – Requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years.

-AB2960 – This bill requires the State Superintendent of Public Instruction (SSPI), within the California Department of Education (CDE), to develop and post on CDE's website a comprehensive childcare and development services online portal for families and providers by June 30, 2022.

Licensee Sarah Davis was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee Sarah Davis and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.

LPA also informed licensee Sarah Davis of the importance of checking for and removing any recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

During the exit interview, the Licensee Sarah Davis, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Deficiencies were cited for 5 Type Type B violations.
No civil penalties were issued on today's inspection.
A notice of site visit was given and must remain posted for 30 days.

Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above in the licensee was operating out of ratio, with 1 infant under at 2 years and 7 children under age 5 for approximately 15 minutes until another adult arrived to assist, which poses a potential health, safety or personal rights risk to persons in care.

The licensee agrees to ensure If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). In addition, the licensee agrees to submit a statement of understanding the regulation, proof of schedule to ensure they will not exceed ratio during operating hours, along with proof of a qualified assistant to help with the care of 10 children enrolled.
