On March 14, 2024 at 01:30 PM , Licensing Program Analyst’s (LPAs) Courtnee Peebles and William Chancellor arrived unannounced to Millar Family Child Care (FCCH) and met with licensee, Audrey Millar to open an investigation based on the allegations above. On March 14, 2024, at 01:30 PM, LPAs conducted a tour and census of the FCCH. During the investigation, LPAs conducted confidential interviews with 1 staff (S1) obtained photographs pertinent to the investigation.

On March 12, 2024, a complaint was received with allegations stating, Licensee is not ensuring the inaccessibility of pool(s) by surrounding the pool with a fence. Based on interviews and observation licensee installed an above ground pool during the middle of summer 2023 without notifying CCL of the changes. Furthermore, licensee does have a six foot white vinyl fencing obstructing the view of the pool and a black mesh fencing circling the pool to prevent access by children however it does not meet Title 22 regulations due to it not being a self latching fence.

102417 Operation of a Family Child Care Home (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to:(5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence.

The ladder to the pool was removed immediately. Licensee will obtain her a new fence surrounding the pool with a self latching gate or replace the self latching gate by COB 04/21/2024 to prevent access to the pool that meets title 22 regulations.

Based on observation and interviews licensee did not comply with title 22 regulations with a properly barricaded fence surrounding the pool with a self latching gate, this poses an immediate risk to the health and safety of children in care.

Based on confidential interviews and observation conducted during the investigation, Licensee is not ensuring the inaccessibility of pool(s) by surrounding the pool with a fence, that obstructs the view of the pool and has a mesh fence that does not have a self latching gate and does meet Title 22 requirements therefore the preponderance of evidence standard has been met and the allegations are substantiated. The Licensee will be cited a deficiency and a $500 Civil Penalty will be assessed. A copy of this report and appeal rights were given and explained to Licensee Audrey Millar.
