Licensing Program Analysts (LPAs) Tricia Danielson and Hayley McCarthy arrived unannounced to the facility to conclude an investigation into the allegations listed above. LPAs met with Interim Director Jacquelyn Negrete and explained the purpose of the visit.
Regarding the allegation "Staff do not ensure that day care child's toileting needs are being met while in care", it was alleged that Child #1(C1) was not being provided adequate potty breaks to ensure toileting accidents did not happen. Interviews conducted with staff revealed C1 had recently moved up to a higher level of learning class as requested by C1's guardian. As the new classroom is considered more independent, potty breaks are not scheduled like C1's previous class and instead rely on the children to vocalize their needs in a timely manner. Regarding the allegation "Licensee is not ensuring that day care children are provided a safe environment while in care", it was alleged that C1 suffered a black eye and bloody nose after they were hit in the head by another child. Interviews conducted revealed C1 prematurely stood up from the table before finishing eating during a party and collided with another child who was playing with a third child. The incident was witnessed by a staff as it occured. (CONTINUED ON LIC 9099-C)

Regarding the incident "Staff leave day care child in soiled clothing while in care", it was alleged that staff left C1 in soiled clothing. Interviews conducted revealed on a particular day, C1 had four toileting accidents which exhausted all of C1's spare clothes that day. Interviews conducted also revealed some confusion regarding whether or not extra clothing had been provided at one point. A review of records confirmed the extra clothing had not been provided as originally thought. Interviews conducted also indicated C1 began a different method of bringing in clothing which was not completely known to all staff resulting in staff not knowing where to find it.
Although the allegations may have happened or are valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation are unsubstantiated. An exit interview was conducted and copy of this report was reviewed with and provided to Interim Director Negrete along with LIC 811- Confidential Names list.
