13 | Licensing Program Analyst (LPA) Tricia Danielson arrived unannounced to the facility to conclude an investigation into the allegation listed above. LPA met with Licensee America Figueroa and explained the purpose of the visit. Regarding the allegation "Staff do not prevent children from hurting other children in care", it was alleged that staff did not prevent Child #2 (C2) from pulling the arm of Child #4 (C4) during an activity. Interviews were conducted with staff, two current and one former. All three staff interviewed reported they did not observe the alleged incident and two staff reported they were not present when the alleged incident occured. Although the allegation may have happened or is valid, there is no preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. An exit interview was conducted, and this report was reviewed with and provided to Licensee Figueroa. Appeal Rights were also discussed and provided. An LIC 9213- Notice of Site Visit was also issued and must remain posted near the main entrance for 30 days. Non-compliance with posting will result in a $100 fine. This report must be accessible to the public for three years. |
