Personal Rights - Staff member throws a bouncy ball at the children and spray children in the face with a water bottle

On Thursday, July 7, 2022, at approximately 8:00 AM, Licensing Program Analyst (LPA) Alize Tillery met with Director, Hannah Verigin, to conduct an unannounced inspection to conclude the complaint investigation and deliver the findings to the above allegation. During today's visit, LPA observed 12 preschool children supervised by 3 staff.

During the course of the investigation, LPA Tillery conducted interviews with the reporting party, parents, 5 staff and 6 children. The complaint allegation is that a staff member throws a bouncy ball at the children and sprays the children in the face with a water bottle. Information obtained during children and staff interviews revealed that Staff #3 threw a bouncy ball at the children, and on at least one occassion, Staff #3 has thrown the bouncy ball at a child's head. The child interview revealed that it hurt when the bouncy ball hit the head of the child. Director stated that she was not aware of the ball to the head incident, but has had a conversation with Staff #3 regarding throwing the ball at children.

Information during children and staff interviews also revealed that Staff #3 sprays children in the face with a water bottle while outdoors. A child interview revealed that they did not like being sprayed in the face with water bottle. Director stated that she has seen children ask staff to spray them with the water bottle, during outdoor water play, but was not aware of children being sprayed that did not like it.

These are an immediate risk as it violates children's personal rights, in that a child should be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation or ridicule.

Based on the evidence gathered, the preponderance of evidence standard has been met; therefore, the above allegation is SUBSTANTIATED.

Upon receipt, licensee shall post and provide copies of this licensing report to parents/ guardians of children who are currently enrolled as well as parents/guardians of children newly enroll at the facility during the next 12 months. Parents/guardians must acknowledge receipt of this report and citation by signing a LIC 9224, “ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS”. A copy of this form should be placed in each child file upon receipt from parent.

LPA reviewed the report with Director and provided copies. Appeal Rights were also issued and discussed. A Notice of Site Visit was issued, and Director acknowledges it must remain posted for 30 days.

On Thursday, July 7, 2022, at approximately 8:00 AM, Licensing Program Analyst (LPA) Alize Tillery met with Director, Hannah Verigin, to conduct an unannounced inspection to conclude the complaint investigation and deliver the findings to the above allegation. During today's visit, LPA observed 12 preschool children supervised by 3 staff.
During the course of the investigation, LPA Tillery conducted interviews with the reporting party, parents, 5 staff and 6 children.
It is alleged that staff are restraining children during nap time by holding the weight of their legs on the children, to get them to sleep. Based on information obtained during staff and children interviews, children are not forced to nap and are given the option to do a quiet activity while other children are napping.
It is also alleged that staff are serving spoiled food to day care children. LPA toured the kitchen and did not observe any spoiled or expired foods. Information obtained during staff interviews revealed that children are not being served spoiled foods and information obtained during parent interviews revealed that staff update parents daily on what the child eats while at the facility. Director stated that the facility has a new cook as of June 1st, who has a current Food Handlers certificate.

It is also alleged that the facility is unclean. Information obtained during staff interviews revealed that they clean during the day and that the janitor of the church cleans the premises at the end of each day. LPA observed the carpets to be stained. Director stated that the carpets are deep cleaned twice a year and that a cleaning company is scheduled to deep clean the carpets in the near future.

Based on observations, record review and interviews, there is not a preponderance of evidence to prove or disprove that the allegations did or did not occur, therefore the above allegations are found to be UNSUBSTANTIATED.

LPA reviewed the report with the Director and an exit interview was conducted.
A Notice of site visit was provided and is to be posted for 30 days.
