On 5/22/2025, Licensing Program Analyst (LPA) Pa Dao Vang met with Director Katherine (Katie) Ibarra, for to conduct an unannounced inspection to deliver a complaint finding. The complaint report was submitted to the regional office on 4/28/2025. It was alleged that staff handled day care child in a rough manner. There were 28 children engaging in activities and supervised by 5 staff at the facility.

During the inspections on 4/29/2025, 5/1/2025, and 5/22/2025, LPA made observations, gather documentation, review a file, and conducted interviews. Throughout these days, LPA witnessed S1 supervising children as they are engaging in activities, servings meals, and redirecting inappropriate behaviors of children. LPA also review the video clip of the incident in the classroom. In the video, LPA observed staff talking to children in care as they started to run around the classroom with toys and items in their hands. S1 followed C1 running to sit in the corner of the classroom. S1 stood over and grabbed C1’s right hand upward, as S1 took the sticker off the top of C1’s right palm along with the toys.

On 5/22/2025, Licensing Program Analyst (LPA) Pa Dao Vang met with Director Katherine (Katie) Ibarra, for to conduct an unannounced inspection to deliver a complaint finding. The complaint report was submitted to the regional office on 4/28/2025 with the above allegation. There were 28 children engaging in activities and supervised by 5 staff at the facility.

During the inspections on 4/29/2025, 5/1/2025, and 5/22/2025, LPA made observations, gather documentation, review a file, and conducted interviews. Throughout these days, LPA witnessed staff supervising children as they are engaging in activities, servings meals, and redirecting inappropriate behaviors of children. LPA witnessed staff speaking to children appropriate with a normal tone of voice. Staff also appropriately redirect children to different activities, when they are having challenging behaviors. According to the Director and staff interviews, they also used a normal tone of voice to redirect the child’s behaviors. The parents and children interviews also did not revealed a preponderance of evidence of staff staff yelling at daycare children. Based on LPA’s investigation, there are no Title 22 violations at the facility.

Therefore, although the alleged violation may have happened or are valid, the preponderance of evidence standard has not been met to fully prove or disprove that they did or did not occur, therefore they are unsubstantiated. There is no deficiency issued today. An exit interview was conducted and notice of site visit and appeal rights were provided to Director Katherine (Katie) Ibarra.

Director will conduct personal rights trainings to help staff use appropriate disciplining, when working with challenging bahaviors of children in care. Director will submit signed agenda of the trainings to LPA by POC due date of 6/23/2025.

Based on observations of the video clip, interviews, and a record review, the facility did not comply with the section cited above by having an incident where Staff #1 handled a child in a rough manner when grabbing C1's hands to remove the sticker and toys, which poses an immediate health, safety or personal rights risk to persons in care.

S1 also stated, “I didn’t know what to do and I removed the sticker from…hand.” In C1’s interview, LPA asked, “Can you show me with my hands what you mean by teacher pulled your hand up?” C1 grabbed both LPA’s hands, squeezed, and pulled them upward.” C2 also stated and showed LPA how S1 held on to C1’s wrist tightly. According to the parent interviews, they do not have any concerns about the staff handled day care child in a rough manner.

Based on the video clip, interviews and inspections, the preponderance of evidence standard has been met; therefore, the above allegation is substantiated. The Title 22 deficiencies are being cited on LIC 9099-D. An exit interview was conducted with Director Katherine (Katie) Ibarra. A notice of site visit, a copy of this report, and appeal rights were provided to Director. Notice of site visit will be posted for 30 consecutive days.
