Licensing Program Analyst Erwina Pascual-Golamco (LPA) and Licensing Program Manager Natalie Dunaway (LPM), met with Licensee Mercy Ishida, to deliver findings of the above allegations at the Sacramento Regional Office.

It was alleged that unqualified staff is providing care and supervision to daycare children, and staff do not provide adequate care and supervision to the daycare children. Throughout the course of the investigation, LPA interviews, observations, and record reviews revealed that staff present at the preschool facility are not qualified or have the appropriate documentation in the file to meet Title 22 requirements. Staff were not qualified for the positions for which they were hired. It was also determined that the current director is not qualified. Interviews revealed that on at least one occasion, a child was reported to have ran away from the facility when children were in the play yard and child pushed open the gate leading to the parking lot. LPA observations, interviews, witness statements, and documentation corroborated the allegation that unqualified staff is providing care and supervision to daycare children, and staff do not provide adequate care and supervision to the daycare children. The preponderance of evidence standard has been met, and the allegation is SUBSTANTIATED.

A Type A Title 22 Deficiency is issued on the attached LIC9099-D page. Director shall provide a copy of this licensing report to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. Exit interview was conducted with Director, appeal rights were provided. A signed Acknowledgement of Receipt of the Licensing Report (LIC9224) must be placed in the child's file for verification.

Licensing Program Analyst Erwina Pascual-Golamco (LPA) and Licensing Program Manager Natalie Dunaway (LPM), met with Licensee Mercy Ishida, for purpose of closing a complaint investigation of the above allegation at the Sacramento Regional Office.

It was alleged that staff yell at the daycare children. Throughout the course of the investigation, LPA toured the facility, observed staff provide care to children, and conducted interviews. Staff interviews revealed that staff redirect children, and model "no thank you, I don't like that," when a challenging behavior arise, and only hear stern voices to get children's attention when they are doing something unsafe. Parent interviews revealed that children love their teachers, and they have not voiced concerns to them regarding staff.

LPA interviews, and observations failed to corroborate the allegation that staff yell at the daycare children. Although the alleged violation may have happened or are valid, the preponderance of evidence standard has not been met to fully prove or disprove that it did or did not occur, therefore, it is UNSUBSTANTIATED.
