25 | Licensing Program Analyst (LPA) Gagandeep Singh met with the facility representative, Kelly Rodgriguez. Purpose of today’s inspection was to deliver the findings of the complaint and discuss other findings that were observed during the investigation.
For the complaint investigation, LPA inspected the facility multiple times. During the inspection on January 23, 2025, LPA observed fourteen children with two aids and no fully qualified teacher on site. There was a qualified teacher available, but she had to remain in infant classroom to keep infant classroom in teacher to children ratio. Based on the interviews, it was found that the only fully qualified teacher, Ngoc Trinh, in preschool classroom leaves at 2 PM, which leaves the preschool classroom out of ratio after 2 PM. On January 23, 2025, Staff Ngoc Trinh left at 1 PM, which left the facility with two aids only and no teacher.
California Code of Regulation for child care in Title 22, Division 12, Chapter 1, Article 6, Section 101216.3 (a) states “There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance”. And Section 101230 (c) states “(c) A teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center. (1) An aide who is 18 years of age or older, and who meets the requirements of Sections 101216 and 101216.2, may supervise 24 napping children in place of a teacher if the conditions specified in (c) above are met.”
LPA also reminded the facility representative that Section 101215.1(d) states “The child care center director, or the substitute director as specified in (f) below, shall be on the premises during the hours the center is in operation.”.
Therefore, the facility was in violation of the regulations. See next page for the deficiency cited. Copy of this report was reviewed and provided to the facility representative. Notice of site visit is posted and shall remain posted for next 30 days.
