Licensing Program Analyst (LPA) Kelly Ferrara conducted a complaint follow up inspection to deliver findings and met with Interim Director Franklin Bay. LPA observed there were currently 49 children in care with seven staff. During the investigation, LPA obtained relevant documentation and interviewed Director and staff.

It was alleged that parents are not allowed to bring in outside food to the center if the child does not want to eat what is being provided for snack or lunch. Director stated that the company policy is outside food is not permitted at the center unless a child has a serious allergy. LPA observed menus at the center and a variety of food is provided as well as alternatives to the meal. Director stated that parents are allowed to submit a Special Accommodations packet to be cleared by their Inclusions Team to bring outside food into the center. LPA observed a denial for a child to bring food from home despite a doctor’s note being provided.

Based on the evidence obtained, LPA determined that the allegations are substantiated, meaning the preponderance of evidence standard has been met. Two type B citations were issued on the following page. Exit interview was conducted and a copy of this report was given to the Interim Director. Notice of Site visit was provided which must remain posted for 30 days.

In child care centers providing meals to children, the following shall apply:
(7) Modified diets prescribed by a child's physician as a medical necessity shall be provided. This requirement was not met as evidenced by: Documentation review and interviews stating that a child was denied a modified diet with a doctor’s note.
