Licensing Program Analyst Erwina Pascual-Golamco (LPA) met with Director, Emily Bell, to deliver findings. It was alleged that staff yelled at day care child. Throughout the course of the investigation, LPA toured the facility, observed staff provide care to children, and conducted interviews. LPA interviews and witness statements revealed that on at least one occasion, staff and parents/guardians observed a staff member yelling at children to have them comply with classroom rules. LPA interviews and witness statements corroborated the allegation that staff yelled at day care child. The preponderance of evidence standard has been met, and the allegation is SUBSTANTIATED. A Type A Title 22 Deficiency is issued on the attached LIC9099-D page. Director shall provide a copy of this licensing report to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. Exit interview was conducted with Director, appeal rights were provided, and a Notice Of Site visit was given to Director, who will post it where visible to parents/guardians for 30 days. A signed Acknowledgement of Receipt of the Licensing Report (LIC9224) must be placed in the child's file for verification.

Director stated they just conducted a training on Love and Logic with staff regarding developing positive teacher-student relationships on August 15th and will review again on their staff training that will be held on Sept. 5th. Director will also review Personal Rights and provide training materials to LPA by POC due date.

Director did not comply with the section cited above as interviews and witness statements revealed that on at least one occasion, staff and parents/guardians observed a staff member yelling at children to have them comply with classroom rules, which poses an immediate Health, Safety, or Personal Rights risk to persons in care.

Licensing Program Analyst Erwina Pascual-Golamco (LPA) met with Director, Emily Bell, to deliver findings.
It was alleged that staff wrongfully terminated day care child and staff speaks inappropriately about day care child. Throughout the course of the investigation, LPA toured the facility, observed staff provide care to children, reviewed documentation, and conducted interviews. Interviews and documentation revealed that the facility terminated a child's care because according to the facility's Parent Handbook and Admission Agreement that was signed by clients and that Director stated are reviewed with clients upon enrollment states: "Termination of Care by Center: Immediate.(1) The Director may terminate your child's enrollment, effective immediately if the child's behavior or your behavior interferes with the school staff providing a safe and educational program either during school hours or school event. (2) You or your child display disrespect for any center staff, other parents or other children at the center either during school hours or school event.

2 Week Notice. (1) The Director may terminate your child's enrollment upon 2 week notice to you if the school's program cannot meet the developmental or special needs of your child. (2) It is not in the best interest of the school or other enrolled children to have your child continue in attendance. (3) If you fail to comply with any of the terms of this Agreement or any of the rules or policies of the center." Parent Handbook has an explanation of Suspended or Dismissed Students on pages 8 and 9. Facility/staff work with children and parents/guardians regarding behavior and developmental needs, and are informed and given notice following the facility's admission agreement. Staff and parent/guardian interviews revealed they have not witnessed nor observed staff speak inappropriately about day care child on occasion when children, staff, or parents/guardians can hear.

LPA Interviews, observation, and facility documentation failed to corroborate the allegation that staff wrongfully terminated day care child and staff speaks inappropriately about day care child. Although the alleged violation may have happened or are valid, the preponderance of evidence standard has not been met to fully prove or disprove that it did or did not occur, therefore, it is UNSUBSTANTIATED.

This report was reviewed with Director, and an exit interview was conducted. Appeal Rights were provided and a Notice of Site Visit (NOS) was provided to Director, who will post it for a period of 30 days for parental review
