Licensing Program Analyst (LPA) Jennifer Velasco met with Facility Representative, Mercy Ishida (Representative), to conduct an unannounced subsequent complaint investigation inspection pertaining to the above allegation. The purpose of today's inspection was explained. During the investigation, LPA conducted interviews, observed care, and requested relevant documentation.
LPA observed staff provide care to children, reviewed facility documents, and interviewed staff and clients. LPA observed the facility's indoor temperature was within the required temperature range and observed the children did not appear flushed or sweaty. Document reviews revealed the facility had operated while the indoor temperatures was higher than the required range. Multiple witness statements were consistent in stating that the facility operated while the indoor temperature was uncomfortably high. Witnesses stated they observed the children and staff were sweaty and flushed. Multiple witnesses stated the facility should have closed when the temperature was too high due to the air conditioning system being broken.

Multiple witnesses stated the air conditioning system had been repaired the day before LPA's initial inspection after having been broken for several days. LPA document reviews and witness statements corroborated the allegation that the facility operated while failing to maintain a comfortable temperature for children. The preponderance of evidence standard has not been met; therefore, the allegations are unsubstantiated.

Exit interview was conducted and report was reviewed with Facility Representative, who was provided with Appeal Rights. Notice of site visit was provided and must remain posted for parental review for 30 days.
