13 | On 10/14/2025, Licensing Program Analyst (LPA) Pedro Solorio-Gutierrez conducted a follow-up investigation and to deliver findings. LPA met with director May Bayani and explained the reason for today’s visit. LPA toured the indoor and outdoor areas of the facility. Present were Teacher Ana Hernandez, Teacher Esperanza Lopez Mendez, Aide Kristin Castro, and seven daycare children - all infants.
During the investigation, LPA conducted observations, interviewed staff, and reviewed records. Based on LPA’s observations, interviews, and record reviews, there have been numerous incidents of biting and biting attempts over many months, and staff have not fully succeeded in preventing harm to other children and staff in care.
Based on LPAs observations, interviews, and record reviews, which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
The following Type A deficiency was cited on the attached page (9099-D). Director was informed that failure to correct the deficiency by the specified Plan of Correction (POC) Due Date may result in assessment of civil penalties in the amount of $100 per day per violation until the correction is made.
LPA Pedro Solorio-Gutierrez informed Director May Bayani that this report dated 10/14/2025 documents 1 Type A citation which shall be posted for 30 consecutive days as there are risks to the health, safety, or personal rights of children in care.
Also, LPA Pedro Solorio-Gutierrez informed the director May Bayani to provide a copy of this licensing reported dated 10/14/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child’s file for verification.
Exit interview was conducted and the report was reviewed with the director May Bayani. Appeal rights was handed to the director.
A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
