On 01/26/2024 at 09:15 AM, Licensing Program Analyst (LPAs) Raymond Moorehead and Tiffanie Diep arrived at the facility to deliver findings for a complaint investigation conducted by LPA Rachel Zeron. Upon arriving LPAs met with Charlene Bunnell Mcalister, Director. LPAs toured the facility and took a census.

It was alleged, Staff are not meeting a daycare child's diapering needs while in care. Based on interviews conducted on or about 10/31/2023 it was revealed that children in the two's room did not receive their first diaper change until 10/11:00 am. Children were dropped off by their responsible parties beginning at 7:19 am, according to a records review conducted by LPA Zeron. According to interviews, children were left in soiled diapers and some soiled through their clothing due to having a soiled diaper an extended period. Some children had experienced redness, which later resulted in a diaper rash.

The evidence gathered during the investigation revealed that the licensee violated children’s personal rights, evidence and documentation gathered corroborates the allegation. Therefore, the preponderance of evidence standard has been met, and the above personal rights violation is found to be SUBSTANTIATED.

See LIC809D for cited Type A deficiency. A Civil Penalty was assessed for a repeat violation of personal rights dated 01/11/2024, which is within the 12 month period.

During the exit interview, LPAs informed Charlene Bunnell-McAlister, Director, that this report dated 01/26/2024 documents 1 Type A citation. Type A citations which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Also, LPAs informed the Charlene Bunnell-McAlister, Director to provide a copy of this licensing report dated 01/26/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Based on interviews and documentation reviewed, staff did not ensure that C1 was clean and comfortable after using the bathroom. C1 developed a rash due to being left in soiled clothing. This poses an immediate health, safety or personal rights risk to persons in care.

On 01/26/2024 at 09:15 AM, Licensing Program Analyst (LPAs) Raymond Moorehead and Tiffanie Diep arrived at the facility to deliver findings for a complaint investigation conducted by LPA Rachel Zeron. Upon arriving LPAs met with Charlene Bunnell Mcalister, Director and explained the reason for today’s visit. LPAs toured the facility and took a census.

During the investigation, LPAs made virtual observations, conducted interviews with staff and all other relevant individuals pertinent to this investigation. It is alleged that on or about July of 2023, Staff mishandled a daycare child while in care, Staff did not prevent a daycare child from hitting another daycare child while in care, Staff did not properly report incidents involving a daycare child, Staff are not providing adequate supervision to the daycare children.

During interviews with staff, staff deny handling children roughly, staff (S1) that was mentioned is no longer working at the facility. Staff indicated that S1 was always kind and loving with the children.

Regarding the additional allegations: Staff did not prevent a daycare child from hitting another daycare child while in care, Staff did not properly report incidents involving a daycare child, Staff are not providing adequate supervision to the daycare children. Staff deny that the allegations occurred and therefore, there was no incident to report. Staff deny that the daycare children were not properly supervised. Interviews indicated that staff do have incidents in the 2’s classroom, examples being hitting, throwing toys and biting. If the incidents are considered reportable, meaning the incidents caused injury, staff will write an incident report and provide the report to the director for parent signature.

There were no witnesses to any incident that occurred. Due to insufficient evidence, LPA was unable to corroborate the allegations of this complaint.

Therefore, due to conflicting information found throughout this investigation this agency has investigated this complaint. Although the allegation may have happened, or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
An exit interview was conducted, and a copy of this report was reviewed and provided to the Director, Charlene Bunnell-Mcalister. Appeal rights were discussed and provided during the exit interview.

Notice of site visit was given and must remain posted for 30 days.
