32 | It was disclosed that the subject children hit and slapped other day care children by using their hands. It was also disclosed, the subject children pulled the hair of other day care children and threw toys at other day care children. Facility records revealed multiple incidents occurred and were documented by staff from 08/07/2024 through 12/17/2024. It was discovered, some occasions during 08/07/2024 through 12/17/2024, documented one of the subject children hit other day care children multiple times within one week, resulting in physical bruising to another day care child one of the occasions. Pertinent parties stated they witnessed the incidents occurring during 08/07/2024 through 12/17/2024, involving the subject children and provided a teaching approach and additional supervision.
It was disclosed during the investigation, that the facility documented the subject children’s challenging behaviors and spoke with the subject children’s authorized representative to address the recurrence of incidents involving multiple children’s aggressive interaction with other day care children. Furthermore, the facility has an established plan of action that identifies challenging behaviors, setting behavior goals, redirection, and authorized representative involvement. It was discovered the facility is not assertively monitoring the progress of the steps outlined in the plan of action. Therefore, day care children are encountering reoccurring incidents of aggression when subject children display challenging behaviors towards other children.
Based on interviews with pertinent parties and records obtained throughout the investigation, the department has determined the preponderance of evidence standard has been met, therefore the allegation of personal rights is found to be SUBSTANTIATED. LPA Taityana Benson informed licensee Director Charlene Bunnell-McAlister, that this report dated 02/07/2025 documents a Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
