On 04/20/2023 Licensing Program Analysts (LPAs) Susan Brewer and Perla Ordones, made an unannounced visit to the facility for the purpose of conducting a complaint investigation and to deliver findings, in regard to the above allegation. The investigation was initiated on 01/26/2023 with LPA Laura Mejorado, and follow-up investigation on 03/24/2023 with LPA Perla Ordones. LPA S. Brewer, were greeted by Director Juliana Tahan, and granted entry into the facility. LPAs met with the Director Juliana Tahan, to discuss the above allegation. LPAs took toured the facility and took a census of children in care.

On today's investigation, LPAs reviewed records, made observations and conducted additional interviews. It was alleged that the facility enrolled a subject child in the preschool program, prior to 24 months of age or 2nd birthday, and that this is a common practice to enroll infant children in the preschool program.

During the course of interviews conducted and record reviews for the preschool program, it was revealed that the licensee operated beyond the licensed age limitations to care for children ages 2 years to Kindergarten, when a subject child was enrolled on 12/01/2023 and began attending at 22.5 months of age in the preschool program. It was indicated by pertinent parties interviewed that this was due to an over enrollment in the infant and toddler program. A review of CSR records for the months of December 2022 and January 2023, confirm that a subject child was included in the roster and marked for attendance with other preschool children in the Two’s Classroom, otherwise known as the Discovery Preschool Program, prior to the subject child’s 2nd birthday.

Based on LPAs interviews with pertinent parties and review of records the preponderance of evidence standard has been met, therefore the allegation that the DIRECTOR ENROLLED INFANT IN PRESCHOOL PROGRAM is found to be SUBSTANTIATED. California Code of Regulations, Title 22 Division and Chapter Numbers 101161 Limitations on Capacity.

A NOTICE OF SITE VISIT WAS ISSUED AND IS TO BE POSTED IN A PROMINENT LOCATION AT THE FACILITY FOR THE NEXT 30 DAYS ALONG WITH A COPY OF ALL TYPE A DEFICIENCIES (9099D) CITED DURING THIS VISIT. A COPY OF ALL TYPE A DEFICIENCIES CITED DURING THIS VISIT MUST ALSO BE IMMEDIATELY (within 24 hours of the child’s next day in care) GIVEN TO THE PARENTS OF ALL CHILDREN ENROLLED IN THE CHILD CARE FACILITY AND ANY CHILDREN ENROLLED INTO THE CHILD CARE FACILITY OVER THE NEXT 12 MONTHS.
