It was alleged a day care child sustained scratches and bumps on their face from another child due to staff neglect and staff/child ratios. Information gathered through facility record reviews, interviews with pertinent parties, and LPA observations revealed the facility was in compliance with staffing ratios during the time of the alleged incident; however, LPAs were unable to determine if the incident occurred due to staff neglect.
It was alleged staff did not notify day care child's parent of incident in a timely manner. Interviews conducted with pertinent parties revealed authorized representatives are notified of incidents either by the KinderCare App, text message, or phone calls. Incidents are documented in writing on the same day of the incident and provided the next time the authorized representative is present. Review of facility records revealed some incident reports were not signed or dated by the children's authorized representatives; therefore, LPAs were unable to determine if authorized representatives were notified of incidents in a timely manner.
Based on interviews with pertinent parties, records reviewed, and facility observations, LPA Susan Brewer, and Perla Ordones, were unable to determine if a child sustained injuries due to neglect or if staff notified a child’s authorized representative in a timely manner. Due to conflicting information found throughout this investigation, the department has determined, although the allegations may have happened, or are valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are deemed UNSUBSTANTIATED.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
