25 | On November 22, 2022, at 03:01pm Licensing Program Analyst (LPA) Zirbes conducted an unannounced case management inspection to Mc Donald Learning Center. The purpose of the unannounced inspection was to follow up on a matter unrelated to this inspection. LPA announced the reason for the unannounced inspection and Assistant Director Courtney Pinkerton granted LPA access to the center.
LPA Zirbes conducted a walk through of Mc Donald Learning Center at approximately 9:20am. LPA observed a total of three infants with staff 1 (S1) in the infant classroom. At approximately 11:55am LPA conducted another walk through of the center. LPA observed S1 and staff 2 (S2) providing supervision to five infants. LPA conducted a file review of S1 and S2 files. Per S1s staff file review, S1 has nine Early Childhood Education (ECE) units, three of which are Infant/Toddler Development. S1 is currently enrolled in ECE classes. Per LPAs review of S2 file, S2 has zero ECE credits. In addition, LPA reviewed the Departments records and found that a exception had not been approved to allow S1 to temporarily act as a fully qualify teacher. LPA spoke with Licensee Lisa Burtner who confirmed S1 is not a fully qualified teacher as of this date. According to Licensee, S1 and S2 were in the infant room together for an hour while the fully qualified infant teacher went on lunch break.
Based on LPAs record review and observation since S1 is not a fully qualified teacher, S1 may not provide supervision of S2, a teacher Aide. S2 who was identified as a infant care aide can only work under the direct supervision of the director, the assistant director or a fully qualified teacher. Therefore, the Center was issued one type B citation for California Code of Regulations, Title 22, Division 12 Chapter 1, 101416.3(b) Infant Care Aide Qualifications and Duties. Refer to the attached LIC 809D.
A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Facility Representative, Lisa Burtner.
