25 | On April 11, 2024, Licensing Program Analyst (LPA) Zirbes conducted a case management inspection to address the discovery of an incident that occurred at the facility. LPA met with Administrator Courtney Pinkerton. Present during today inspection were four infants and one teacher.
The Department discovered through confidential interviews that on March 21, 2024, between 2:00 p.m. and 3:00 p.m., staff 1 (S1) and staff 2 (S2) were providing supervision to the infants in care. According to the information obtained through interviews and facility records, one additional teacher aide (staff 3) and one teacher (staff 4) were on the grounds at the time of the incident. However, according to interviews S3, and S4 were providing supervision in the preschool and school-age components. Two additional teachers were on their lunch break and were not immediately available. LPA reviewed the safe sleep logs for March 21, 2024. Between 2:00 pm and 3:00 pm. An infant in care woke up from their nap, therefore S1 and S2 were providing supervision to non-napping infants. Attendance records for March 21, 2024, documented that five infants were in care. According to information obtained through interviews with the administrative staff, S1 and S2 are teachers' aides. A review of the facility records revealed S1 and S2 have zero early childhood education or child development units. Therefore, S1 and S2 can only work under the direct supervision of the director, the assistant director, or a fully qualified teacher. The Center was issued a Type A citation for California Code of Regulations, Title 22, Division 12 Chapter 1, 101416.3(b) Infant Care Aide Qualifications and Duties. This Center was previously cited under regulation 101416.3(b) on September 13, 2023, therefore this is a repeat citation, and civil penalties were assessed. Refer to LIC 809D.
LPA Zirbes informed administrator Courtney Pinkerton that this report dated April 11, 2024, documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.
