On 02/13/2023 at time listed above Licensing Program Analyst (LPA) Justin Giese made an unannounced visit to the facility for the purpose of concluding a complaint investigation. LPA met with Facility Director, Emily Calhoun regarding the above allegation, which was received by Licensing on 01/31/2023.

The following was alleged: Day-care child was left in a soiled diaper for a long period of time.

It was alleged, on 01/30/2023, facility staff member(s) did not meet the diapering needs of a child in care. It was reported that when the child was picked up by their authorized representative around 05:30pm they were observed to be wearing an oversaturated pull-up trainer. Additionally, it was reported the facility did not log or report toileting activities for the child on this date.

Director understand the inportance of this regulation and agrees to conduct in person training with staff pertaining to meeting children's diapering/potty training needs. Director will discuss the importance of documenting diapering and potty training consistently in the Kindercare app.

Based on LPA observation, records reviewed and interviews conducted, Facility staff could not recall changing or toileting the child from 4:07pm until 5:33pm. Additionally, staff did not log any diapering changes or potty training attempts in the Kindercare app. This is an immediate risk to the health and safety of children in care.

On 02/07/2023 LPA made an unannounced visit to the facility for the purpose of initiating this complaint investigation. LPA reviewed records/documents and interviewed the facility Director, Assistant Director and six facility staff members. Through the course of interviews, LPA recorded consistent statements form all staff interviewed pertaining to properly documenting children’s daily toileting/diapering activities. Staff stated children wearing diapers/training pants will be checked upon arrival and every 2 hours thereafter. Additional checks will be conducted after snack/lunch and before/after napping. Staff stated the facility logs diapering and/or toileting events in the Kindercare app.

LPA conducted a review of the Kindercare app for the day the alleged incident had occurred. LPA observed the log for the Child to be completely blank with no data for diapering/toileting. In conjunction with the app's review for this day, LPA reviewed the Child Supervision Records (CSR: Name to Face) logs for the entire preschool program. The CSR logs identified the classroom the child attended on this date as well as all of the staff member's in/out times while providing supervision in this classroom. The CSR revealed the child was in attendance for this particular classroom from 8:22am to 04:07pm with a total of 6 staff members entering/exiting the class in this time frame. LPA further reviewed the Kindercare app and observed the Child was not released from the facility until 05:33pm.

LPA reviewed CSR logs for all classrooms for the date of alleged incident but was unable to verify the Child’s attendance or staff providing supervision for the Child’s classroom from 04:07pm to the time the child was picked up from the facility at 05:33pm. Although additional CSR logs were not documented by Facility Staff, LPA reviewed data available in the the Kindercare app and observed the child had transitioned classrooms three additional times from 04:07am to 5:33pm.

Statements recorded from staff revealed that as children are picked up from the facility and staff end their daily shifts, children are moved from one classroom to another to maintain proper staff/child ratios. Children can change classrooms multiple times towards the end of the day. In this time frame staff members transition in and out of classrooms, often providing brief supervision periods. This is due to staff ending their daily shifts or relieving one another for scheduled breaks. Since no additional CSR logs were completed once the child transitioned classrooms and no diapering/toileting was logged in the Kindercare app, LPA recorded conflicting information from staff interviewed pertaining to duration of time supervision was provided between 04:07pm and 05:33pm.

Additionally, interviews revealed that three staff members self identified as working during this time frame. All staff members working during this time frame corroborated statements they did not recall toileting/changing a child in pull ups due to periods of supervision being brief or the child transitioning to another classroom. Interviews further revealed the same three staff were aware a child in attendance was still utilizing a pull-up trainer and not yet fully potty trained.

Facility staff could not recall changing or toileting the child in this time frame. Paper supervision records and duration of time staff supervised the child as they transitioned classrooms was not maintained on the day the incident allegedly occurred. Additionally, staff did not log any diaper changes or potty training attempts in the Kindercare app. Therefore, based on LPAs observations, interviews conducted, and records reviewed/obtained, the preponderance of evidence standard has been met, therefore the above allegation, Day care child was left in a soiled diaper for a long period of time, are found to be SUBSTANTIATED. Please see attached LIC9099D for Type A deficiency cited.


An exit interview was conducted, A copy of this report and appeal rights were given to the Director during this inspection on 02/13/2023.

LPA issued a Notice of Site Visit and verified it was posted in a prominent location at the facility. Director understands that the Notice of Site Visit must remain posted for the next 30 days along with a copy of all Type A deficiencies cited during this inspection. A copy of all Type A deficiencies cited during this inspection must also be immediately (within 24 hours of child’s next day in care) given to the parents of all children enrolled in the child care facility and any children enrolled into the child care facility over the next 12 months (at the time of enrollment). Licensees are required to have all parents sign and date the Acknowledgement of Receipt of Licensing Reports (LIC9224) and maintain a copy in each child’s file. A copy of this report, LIC9224 and Appeal Rights (LIC9058) were provided during this inspection.
