On 10/18/2022, Licensing Program Analyst (LPA) Destinee Hogue conducted an unannounced complaint inspection to deliver findings of the above complaint allegation. A 10-day inspection was initiated by LPA Hogue on 09/19/2022. During the initial inspection, LPA Hogue interviewed pertinent parties, reviewed records, conducted facility observations and met with Assistant Director, Ruth Deanda. The following was discussed with Director Emily Calhoun:

It is reported, during the week of Tuesday, September 6, 2022 to Thursday, September 8, 2022, staff member(s) did not meet the diapering needs of a child(ren) in care. It is reported, on more than one occasion, a child(ren) in care was left in a wet and/or soiled diaper for more than two hours which caused the child(ren) to receive a severe diaper rash.

LPA Hogue interviewed Assistant Director Ruth DeAnda. According to Assistant Director, on or about September 8, 2022, a child(ren) was sent home early after having more than one diarrhea accident. Per Assistant Director, it is KinderCare’s policy, to send a child home, if a diarrhea accident is coming out on the sides of a child(ren)’s diaper. According to Assistant Director, staff member(s) are required to change a diaper every two hours and check a child(ren)'s diaper every hour. Interview with Assistant Director disclosed that staff member(s) should document diaper checks and diaper changes on Diaper Log and KinderCare app. Per Assistant Director, staff member(s) should document when a child(ren) has a diaper rash and/or when diaper cream is applied.

Further interviews conducted by LPA Hogue disclosed, that staff members are required to check diapers every hour and change a wet, dry, or soiled diaper every two hours or as needed. Interviews disclosed that some staff member(s) will document when a child(ren)'s diaper is checked and does not require a diaper change.

Throughout the investigation, LPA Hogue reviewed facility records, specifically paper and KinderCare app Diaper Logs. After reviewing Diaper Logs, during the week of September 6, 2022 to September 8, 2022, a child(ren)’s diaper was not changed between the hours of 11:00am to 2:45pm which left a child(ren) in a wet or soiled diaper for more than two hours.

Based on the information that was obtained throughout the investigation, the preponderance of evidence standard has been met, therefore the allegation is found to be Substantiated.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed with the Director, Emily Calhoun.

INFANT CARE PERSONAL SERVICES. (b) The infant shall be kept clean and dry at all times. (1) The infant care center shall ensure that the infant has sufficient changes of clothing and diapers so that his/her clothing and diapers can be clean and dry at all times.

Per Director, the subject staff member(s), no longer works at the facility effective 09/26/2022. Director stated, staff will begin to document children's napping time on diaper log. DIrector stated staff will begin to utilize timer on KinderCare tablet in order to keep track of diaper checks and changes.

Based on records review and interview disclosures, staff member(s) did not change a child(ren)'s diaper within a two hour timeframe which left a child(ren) in a wet or soiled diaper for more than two hours which poses a potential health, safety, and personal rights risk to children in care.

Director agrees to re-train staff on Infant/Toddler diapering policy and discuss the importance of documenting the diaper log consistently.
Director stated training will take place on 11/02/2022. Director agrees to submit training agenda and training sign in sheet on or by 11/04/2022.
