Interviews conducted disclosed a staff member (S2) grabbed a day care child’s (C1) wrist in an inappropriate manner and is mean to C1. During interviews with staff, it was denied that the incident occurred as staff did not disclose witnessing staff grabbing children at the facility. It was disclosed staff help children by holding their hands when sitting down or transitioning. Interviews conducted indicated staff holding children’s hands may be perceived as grabbing in an inappropriate manner when accidents occur, such as a child falling to the ground while staff are holding their hand. Video footage on 10/03/2024 revealed a staff member (S3) grabbed C1’s wrist and forcefully sat them down when C1 was not listening. Video footage on 10/08/2024 revealed two children (C2 and C3) chasing one another in a classroom. It was revealed that S3 grabbed C2’s arm and forcefully sat them down. It was also revealed S3 picked up C3 from one area of a classroom, carried them to another area of the classroom in an inappropriate manner, and forcefully sat C3 down.
Based on observations and evidence collected, including information obtained during interviews and records reviewed, the preponderance of evidence standard has been met; therefore, the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12, Chapter 1), are being cited on the attached LIC 9099-D.
LPA Tiffanie Diep informed the director, Ruby Calderon, that this report dated 12/05/2024 documents one Type A citation which shall be posted for 30 consecutive days as there was an immediate risk to the personal rights of children in care.
Also, LPA Tiffanie Diep informed Director to provide a copy of this licensing report dated 12/05/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgment of Receipt of Licensing Reports (LIC 9224), or other written statement, must be placed in the child’s file for verification.
An exit interview was conducted and report was reviewed with the director, Ruby Calderon. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
