Licensing Program Analyst (LPA) Rachel Zeron arrived at the facility to conduct a 10 day visit regarding a complaint received by the regional office on 07/26/2023. LPA Zeron toured the facility and took a census. LPA Zeron met with Ariana Ramos to further discuss the complaint/allegations. On today's visit, staff were interviewed, pertinant documents reviewed.

LPA Zeron investigated the above allegation and gathered the following information regarding the issue concerning an unqualified staff providing care and supervision to day care children. The center is set up with two programs, a preschool program that resides in classroom B and C and a private kindergarten that resides in classroom A and D. The facility currenly holds a waiver that allows these two programs to comingle in the same classroom at the beginning and end of each day. It was disclosed that there was teacher's aide that was hired to assist a teacher in Classroom A, this teacher was pending fingerprint clearance, but was placed on the schedule as a closer with the preschool teacher. As a closer this required the kindergarten teacher's aide to comingle in the preschool classroom B with a fully qualified preschool teacher at the end of the day, from 5:00 pm to 6:00 pm. Due to the teacher's aide fingerprint staus, which was "in progress" this put the facility in violation of Title 22.

Based on LPA observations and interviews which were conducted and a review of additional pertinent information obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC 9099D.

The Director Ariana Ramos was provided a copy of their appeal rights (LIC9058) and their signature on this form acknowledges receipt of these rights.See LIC 809D for deficiencies cited. This is a ZERO-TOLERANCE violation that presented and immediate risk to the child's safety. A Civil Penalty was assessed.

Upon receipt of this report, licensee is required to provide a copy of the LIC9099D documenting Type A deficiencies to children's parents and obtain signatures from the parents on Form LIC9224. For the next 12 months, licensee is required to provide a copy of the LIC9099D to all newly enrolled families. A copy of this report must be made available to the public upon request for the next 3 years.

During the investigation, LPA Zeron made observations, conducted interviews with Director and all other relevant individuals pertinent to this investigation. It was alleged that children's personal rights were violated according to the allegations listed above.

During interviews with staff and children, Staff denied any inappropriate behaviors towards children. It was disclosed that there are two children that need more attention during nap time, teacher's will use different techniques to sooth the children, including patting, rubbing the back and head to help the child sleep. Staff also disclosed that there is one child in particular that responds in a positive manner to a more firm pat on the back, this is soothing to the child, according to staff. Children's interviews revealed that teachers are nice and that they like when teachers pat their back, some children did not understand the questions and were unable to give a stable response. Children denied being pinched by teachers or being forced to sleep. Staff interviews indicated that they have not been unfriendly towards children, nor have they witnessed other staff display unfriendly demeanor towards children. Staff indicated that children are not forced to sleep but will be given an activity on the their mat if they choose not to sleep.

LPA observed children at nap time, teacher was patting children and the one child in particular with a firm pat and the child was observed to be calm and at peace.

Due to conflicting statements, LPA cannot determine if the above allegation is true. Although the allegation may have happened or is valid, there is no preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is deemed unsubstantiated at this time.

An exit interview was conducted with the Director, Ariana Ramos. A copy of this report was provided .A Notice of site visit was given to the Director and LPA observed the notice posted. Director agreed to keep the notice posted for the next 30 days

Director indicated that she would review and verify that all staff are fingerprinted prior to starting at the facility. Director will submit a letter of understanding to the Department by POC date. Staff #1 is no longer employed at the facility.

Based on LPA's review of facility associations, The Licensee/Director did not get a clearance prior to Staff #1 working with preschool children. This poses an immediate health, safety, and personal rights risk to children in care.
