On November 16, 2023, Licensing Program Analyst (LPA) Kris Diaz conducted an unannounced
Complaint Investigation Inspection to deliver findings for a complaint received August 29, 2023. LPA was granted access to the center by Lead Infant Teacher, Michella Evans. Per facility representative, the Director is away at an appointment. LPA advised facility representative to contact and inform Director that licensing is present in the facility. LPA conducted a safety inspection where zero deficiencies were noted. At the time of the visit LPA observed 24 preschoolers in care with 3 teachers. LPA observed 9 children in the room of potty-trained children with 1 staff and 15 in the potty-training room with 2 staff. Two other staff arrived during the visit.

During this investigation, the facility representative provided documentation related to the investigation including children's rosters, staff rosters and schedules, sign-in/out sheets, and vehicle documentation. LPA conducted record reviews and confidential interviews.

Confidential interviews revealed that staff do not clean the playground area at least once per week. LPA requested cleaning logs that were not available at the time of inspection on 9.7.23 or 10.10.23. LPA observed the facility van in poor sanitary condition and interviews revealed there is no cleaning log or expectations of cleanliness. LPA observed staff handling children in care roughly and speaking to children in an undignified manner. Based on LPAs observations, interviews conducted, and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

California Code of Regulations (Title 22 regulation - see LIC9099D) requires licensee to ensure the outdoor activity space be free from hazards, the childcare center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, and children in care should be accorded dignity in his/her personal relationships with staff and other persons.

2 Type B deficiencies will be assessed for the above violations.

LPA observed the following repairs to the playground area at the facility during today's visit: all equipment and structures were painted, the gate in the play area was repaired, and some unsafe structures were removed and no longer pose a health and safety risk to children in care.
