On the date and time listed, Licensing Program Analyst (LPA) Perla Ordones conducted an unannounced visit to complete and deliver findings for a pending complaint that was filed on 10/10/2023. LPA met with the Director, Charmaine Maligaspe, and explained the reason for the visit. LPA Rachel Zeron previously conducted a visit on 10/13/2023 to initiate the complaint and begin the investigation.

During the investigation, LPA Rachel Zeron and Perla Ordones reviewed facility documentation, made observations, and conducted interviews with relevant individuals pertinent to this investigation. The allegations that staff change infant diapers on facility carpet without a changing pad and staff do not ensure infants have proper napping equipment were investigated by the Department. The facility denied these allegations to be true, but due to substantial evidence obtained by the Department, these allegations were deemed substantiated. Additionally, during a facility tour conducted by LPA Ordones, it was observed that children's bedding had come into contact with one another which is a violation of regulations.

On the date and time listed, Licensing Program Analyst (LPA) Perla Ordones arrived at the facility to deliver the findings of this complaint investigation which was initiated by LPA Rachel Zeron on 10/13/2023. LPA met with Director Charmaine Maligaspe. LPA toured the facility, took census, and discussed the following with the Director.

During the investigation, LPA made observations, reviewed pertinent documentation and conducted interviews with pertinent parties.

It was alleged, staff fed spoiled milk to infants in care, infant diapering needs were not met by staff resulting in diaper rash, staff do not practice proper hand hygiene when changing diapers, infant toys are not kept clean, and medications are not properly stored.

1. Staff fed spoiled milk to infants in care:
It was reported, on or about August or October 2023, that a staff member had fed sour milk to the children in care and did not notice which caused a daycare child to have symptoms of diarrhea and vomit the next day. LPAs conducted interviews with pertinent parties and were told that spoiled milk has never been given to daycare children. Interviews revealed that excess milk is thrown out at the end of every day and that dishes are washed as well. Additionally, it was disclosed that new milk is brought by authorized representatives every day. LPA toured the facility and did not observe any spoiled milk in children’s bottles or being fed to children in care during that time.

2. Infant diapering needs were not met by staff resulting in diaper rash:
It was reported, on or about August or October 2023, that a staff member was not changing daycare children's diapers as needed and that children had soaked diapers which were not changed. Interviews were conducted with pertinent parties who stated that daycare children’s diapers are changed every hour and as needed. It was disclosed that whenever a child has bowel movement, diapers are changed immediately. It was also disclosed that some children in care have a medical condition which may cause a type of rash to form. LPA toured the facility and noted that infant classroom had new diapers present in the changing table storage area to be used as need be at that time.

3. Staff do not properly following infant care food service procedures:
It was reported, on or about August or October 2023, that a staff member did not follow an Infant Needs and Services Plan. LPA reviewed Infant Needs and Services Plan as well as Infant Daily Report Sheets for infants in care. LPA observed that while the daily report conflicts with the Infant Needs and Services Plan on file, the Infant Needs and Services Plan is not dated. it is unclear whether the Infant Needs and Services Plan is up to date and reflects the child's current dietary needs.

4. Staff do not practice proper hand hygiene when changing diapers:
It was reported, on or about August or October 2023, that a staff member was changing diapers without washing hands afterwards. LPA conducted interviews with pertinent parties where it was disclosed that staff wash their hands throughout the day, especially after changing diapers and before feeding children. LPA conducted a facility tour and did not observe staff change diapers or wash hands during that time.

5. Infant toys are not kept clean:
It was reported, on or about August or October 2023, that the facility is not sanitizing the children’s play equipment. It was stated that the children’s toys have been observed to be dirty. LPA conducted interviews with pertinent parties where it was disclosed that children’s toys are cleaned daily and as time permits throughout the day. LPA conducted a facility tour and did not observe any infant toys that would pose a potential hazard to children in care.

6. Medications are not properly stored:
It was reported, on or about August or October 2023, that diaper rash ointment was left in an accessible area to children in the infant classroom. Interviews were conducted with pertinent parties which disclosed that diaper rash ointment is brought out to use while changing diapers but is stored away after use. Additionally, it was disclosed that diaper rash ointment is stored in an inaccessible area while not in use. LPA toured the facility and did not observe diaper rash ointment in an accessible area at that time.

Based on information obtained during this investigation through interviews conducted, the review of pertinent documentation, and after receiving conflicting information, the allegation is UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Based on documentation received to support these allegations, interviews conducted, and observations, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC9099D.

LPA Perla Ordones informed Director Charmaine Maligaspe that this report dated 01/10/2024 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Perla Ordones informed the Director Charmaine Maligaspe to provide a copy of this licensing report dated 01/10/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Based on interviews and documentation received, the licensee did not comply with the section cited above as children are changed on the floor without a changing pad and do not have comfortable and sanitary sleeping equipment. This poses an immediate health, safety, or personal rights risk to persons in care.
