It was alleged that the facility staff did not prevent facility from being hazardous. On 02/18/2025 the LPAs made observations of the facility entrance ramp used for the public to enter the infant center. The ramp was observed to be made up of multiple materials of wood, plywood, metal framing and railing. The LPAs S. Brewer and L. Mejorado observed the ramp to be damp from recent rains and in the beginning stages of deterioration, where the ramp showed signs of the material wood to be chipping, paint chipping, low spots and bowing. On today’s date, LPA S. Brewer, conducted a follow-up inspection of the ramp and observed the ramp to now have advanced deterioration, where the wood is now starting to cave in when stepping on certain areas the ramp. In addition the wood is now separating from framing and railing. Pertinent parties interviewed stated the ramp is old, unsafe to walk on and stated their fears of the ramp collapsing or falling through the ramp. The director admitted they observed the ramp to be in need repairing, and stated they had intentions of repairing the walk-up ramp but have been unable to do so with the weather and rain.
Based on LPA’s observations, interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation that facility staff did not prevent facility from being hazardous is found to be SUBSTANTIATED. California Code of Regulations, Title 22, 101238 (c) Buildings and Grounds is being cited on the attached LIC9099D.
LPA Susan Brewer informed the licensee Director Charmaine Maligaspe that this report dated 03/17/2025 documents a Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Susan Brewer informed the licensee Director Charmaine Maligaspe to provide a copy of this licensing report dated 03/17/2025 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report LIC9224, or other written statement, must be placed in the child's file for verification.
No civil penalties issued on today’s date.
A notice of site visit was given and must remain posted for 30 days.
