On the above date and time Licensing Program Analyst (LPA) Susan Brewer, arrived unannounced for the purpose of continuing a complaint investigation and to deliver findings. The LPA was greeted by a center staff and granted entry to tour the facility inside and out. The LPA took a census of 5 children in the care of two staff. The director was temporarily way from the facility and arrived at 9:30 AM to join the investigation.

The investigation was initiated on 02/18/2025 by LPAs Susan Brewer and Laura Mejorado. LPAs met with the Director Charmaine Maligaspe to discuss allegation regarding the Physical Plant, made observations, reviewed records and conducted interviews with pertinent parties, however the director was informed that more time was needed to complete the investigation. During today's investigation the LPA Susan Brewer made additional observations, reviewed records and conducted interviews with parties relevant to the allegation.

It was alleged that the facility staff did not prevent facility from being hazardous. On 02/18/2025 the LPAs made observations of the facility entrance ramp used for the public to enter the infant center. The ramp was observed to be made up of multiple materials of wood, plywood, metal framing and railing. The LPAs S. Brewer and L. Mejorado observed the ramp to be damp from recent rains and in the beginning stages of deterioration, where the ramp showed signs of the material wood to be chipping, paint chipping, low spots and bowing. On today’s date, LPA S. Brewer, conducted a follow-up inspection of the ramp and observed the ramp to now have advanced deterioration, where the wood is now starting to cave in when stepping on certain areas the ramp. In addition the wood is now separating from framing and railing. Pertinent parties interviewed stated the ramp is old, unsafe to walk on and stated their fears of the ramp collapsing or falling through the ramp. The director admitted they observed the ramp to be in need repairing, and stated they had intentions of repairing the walk-up ramp but have been unable to do so with the weather and rain.

Based on LPA’s observations, interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation that facility staff did not prevent facility from being hazardous is found to be SUBSTANTIATED. California Code of Regulations, Title 22, 101238 (c) Buildings and Grounds is being cited on the attached LIC9099D.

LPA Susan Brewer informed the licensee Director Charmaine Maligaspe that this report dated 03/17/2025 documents a Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Susan Brewer informed the licensee Director Charmaine Maligaspe to provide a copy of this licensing report dated 03/17/2025 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report LIC9224, or other written statement, must be placed in the child's file for verification.

No civil penalties issued on today’s date.
A notice of site visit was given and must remain posted for 30 days.
Exit interview conducted and report was reviewed with the licensee Director Charmain Maligaspe.

Based on LPA observations, interview and by the licensee's own admission, the facility ramp used by the public to enter the infant center is in the advanced stages of deterioration which is an immediate risk to the health and safety of the children in care and the public.

The licensee also agrees to submit proof of the work order in place to repair of outdoor entrance ramp for the infant center is sent to the department by fax, mail or e-mail.

It was alleged that the facility staff uses inappropriate language towards children in care. LPAs made observations and did not observe any violations consistent with the allegation. During interviews conducted with pertinent parties, some parties stated a subject staff is direct when speaking with children, however the staff is loving, playful, giving and likes to use humor when speaking children and the public. The same parties denied the allegation and stated the subject staff is not verbally abusive towards children.

Other pertinent parties interviewed stated a subject staff uses an inappropriate tone of voice and language around the children and about children, however the children are infants and too small to understand what is being said by the staff. Based on LPA observations, record review and conflicting information gathered during the interviews, the allegation is determined to be unsubstantiated.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED.

A deficiency was not issued on today’s date for this allegation.

No civil penalties issued on today’s date.
