Due to COVID-19, a tele-inspection was conducted. On 4/9/2021 at 2:58pm, Licensing Program Analyst (LPA) Kim Leung met with director Pamela Fox via FaceTime conducting a case management inspection. An application was received on 3/30/2021 requesting to add Room 7 and the Pre K Playground back to the preschool license and increase the capacity from 120 children to 144 children. Facility was originally licensed for a capacity of 144 and the capacity was lowered to 120 on 10/20/2020 per the licensee's request.

Indoor Activity Areas
Measurements of Room 7 were taken during the prelicensing inspection on 1/23/2019. Per the measurements on file, LPA has determined that there is sufficient space to accommodate 144 children in Rooms #3, 4, 5, 6, 7 and 8.

Bathroom Fixtures
12 toilets x 15 = 180 children
17 sinks x 15 = 255 children

Outdoor Activity Area
Per measurements on file, LPA has determined that there is sufficient space to accommodate 121 children on the Main Playground and the Pre K Playground. A waiver is on file allowing scheduled use of the playground.

During this inspection, the director guided LPA on a virtual tour, inside and out. The following was observed:
· The facility is operating with the limits as stated on the license
· Ratios are being met during this inspection
· Classrooms are adequately equipped with age appropriate furniture and equipment
· There are no weapons present at the facility as stated by director Pamela Fox

· There are no accessible bodies of water present. All wading pools or similar product must be emptied immediately after use and stored in an upright position.
· Drinking water is available indoor by use of pitchers of water and disposable cups. At 3:33pm, LPA observed no drinking water available on the playground while the 2's classes were having outdoor activities. As stated by the director, the drinking fountain is covered following health guidance during the COVID-19 pandemic and staff is supposed cart the drinking water out to the playground each time children are out on the playground. Director stated that staff did not bring the water out to the playground when they took the 2's classes to the playground.
· Medications are stored in the director's office where inaccessible to children,
· Hazards are stored where inaccessible to children which include: Disinfectants, cleaning solutions and other items that are dangerous. Poisons and toxins are locked.
· All floors are clean and safe. Bathrooms were observed to be safe, sanitary and in operating condition.
· Playgrounds are enclosed by appropriate fences and free of hazards
· Outdoor activity areas are supplied with age and size appropriate equipment in good condition
· Kitchen is clean, free of litter, rubbish and free of rodents and other vermin
· Food is stored appropriately and protected from contamination
· All storage containers for solid waste, including moveable bins have tight-fitting covers that are kept on, and in good repair
· Menu is posted for the current month at the front office
· The areas around or under high climbing equipment, swings, slides, and similar equipment are cushioned with material (rubber filler) that absorb falls
· Sign in/Sign out record was reviewed and regulatory requirements were reviewed with the director during this inspection
· Director and Assistant director open and close the facility each day. Director's CPR/First Aid expired in
February 2021. Assistant director's CPR/First Aid expired on 11/27/2020. As stated by director, they have not been able to attend an in-person CPR class due to the COVID-19 pandemic. Director will submit a written request for a temporary waiver while making effort to complete the current training.
· Director completed Health and Safety Training
· Documentation of disaster drill on file. Last drill was conducted on 4/7/2021
· A review of staff records on 4/9/2021 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The following was reviewed and discussed:
v AB 2621 – Public Information effective January 1, 2015 – The Department shall post licensing reports for Child Care Facilities on its internet Web site. This information is to be updated at least monthly on the website and will span the preceding five-year period.
v AB 2236 – Civil Penalties, effective July 1, 2015 – Enacts new civil penalties in cases where the Department determines that a violation of licensing standards resulted in the death or serious injury, or constitutes physical abuse of a child in care. The bill establishes an appeal procedure specific to these civil penalties. The bill also expands the scope of the Child Health and Safety Fund in order to assist parents in securing alternative child care when a Child Care Center license has been suspended or revoked. These civil penalty amounts are scaled in relation to the total capacity of all of the licensee’s facilities and not just the specific facility cited or limited to that facility type.
v AB 2386 – Carbon Monoxide Detector Regulations, effective January 1, 2015 – In accordance with California Health and Safety Code Section 1975.543 - Every child care center shall have one or more carbon monoxide detectors in the facility that meet the standards established in Chapter 8 (commencing with Section 13260) of Part 2 of Division 12. The department shall account for the presence of these detectors during inspections

v - SB 277 – Immunizations, Personal Beliefs Exemption, effective January 1, 2016 - it eliminates the exemption from existing specified immunization requirements based upon personal beliefs, and only allows an exemption from future immunization requirements deemed appropriate by the State Department of Public Health or a medical professional for medical reasons.
v - AB290 – Child Nutrition, effective January 1, 2016 - In accordance with California Health and Safety Code Section 1596.866 - each child care center shall have at least one person employed who was completed one hour of childhood nutrition training as part of the preventive health practices course or courses.
v - SB792 – Immunization requirements for staff, volunteers, effective September 1, 2016 – In accordance with California Health and Safety Code Section 1596.7995(a)(1) - Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. If employees/volunteers are receiving the influenza vaccination, they must do so between August 1 and December 1 of each year.
v - AB2231 (2016) – Increased Civil Penalties, effective July 1, 2017 – For failing to correct a violation the civil penalty is increased to $100 per day for EACH violation until corrected; For failing to correct a repeated violation the civil penalty is increased to $250 immediately assessed , and $100 per day afterwards for EACH repeated violation until corrected; For a Zero Tolerance violation the civil penalty is increased to $500 immediately assess, and $100 per day for EACH violation after that until corrected; For any repeated Zero Tolerance violation the civil penalty is increased to $1,000 immediately assess, and $100 per day afterwards for EACH repeated violation until corrected.

applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Applicants must meet requirements as a precondition to licensure. Existing licensees must meet requirements by March 30, 2018. New employees shall have 90 days to complete training as required. This training requirement may be directly met by using the Department’s Office of Child Abuse Prevention (OCAP) online training modules. The OCAP modules are free of cost and available at: http://www.mandatedreporterca.com/ and are provided in English and Spanish. If no training is made available in a required person’s primary language then those persons shall be exempt from this requirement
v AB2370 – Lead Exposure, day care facilities, effective January 1, 2019 - An act amending Sections 1596.866 and 1596.8661 and adding Sections 1596.7996 and 1597.16 to the Health and Safety Code for the education of risks and effects of lead exposure in child care facilities and for the testing of drinking water in licensed child care centers. Licensed providers have access to a document regarding lead toxicity prevention created in partnership with the California Department of Public Health (CDPH) to provide to parents/guardians of newly enrolled or reenrolled children with information on the following:
· Risks and effects of lead exposure
· Blood lead testing recommendations and requirements
· Options for obtaining blood lead testing, including any programs that offer free or discounted tests
v This printable document (Lead Poisoning Facts) is located here as well as on the Child Care Licensing website. The bill also requires that the Department add instruction on the prevention of lead exposure to the Preventative Health and Safety Training curriculum for providers licensed on or after July 1, 2020. Finally, it requires that all Child Care Centers, operating in a building constructed before January 1, 2010, shall have their drinking water tested for excessive lead levels, on or after January 1, 2020, but no later than January 1, 2023. Child Care Centers must thereafter test their drinking water every five years after the date of the initial test. The Department must adopt regulations in consultation with the State Water Resources Control Board for the implementation of the requirements for the testing of drinking water for lead in Child Care Centers by January 1, 2021. The regulations shall include requirements to ensure the collection and submission of valid water samples.

Director Pamela Fox confirmed that there are no Registered Sex Offenders living in the facility and/or using the facility address for their mailing address.

See LIC 809D for deficiency cited. A sample of the staff records and children's records were requested during inspection. Licensee agreed to submit the records for review by close of business this date on 4/9/2021.

Prior to approval of capacity increase, the following is required:
- Complete the required correction
- Submit a written waiver request on the renewal of CPR/First Aid training

The application for capacity increase will be submitted for approval if the facility is in compliance with record keeping requirements and all of the above have been completed.

· The licensee is asked to update the following documents, if applicable, and submit to licensing within 30 days:
1. LIC 500 Personnel Report
2. Parent Handbook/ Program Curriculum/Admission policies and procedures/ fee schedule (only if changes have been made)

An exit interview was conducted with Ms. Fox. A new fire clearance is on file. LPA provided the director with a copy of this report along with a Notice of Site Visit via email this date on 4/9/2021. THE NOTICE OF SITE VISIT IS TO BE POSTED IN A PROMINENT LOCATION AT THE FACILITY FOR THE NEXT 30 DAYS. Director agreed to acknowledge receipt of the email. An electronic “read receipt” was also attached. The electronic read receipt of the emailed report acknowledges receipt of this report.

This report must be made available at the facility for 3 years for public review upon request.
