****AMENDED REPORT**** This is an amended report of page(s) LIC809 and LIC809D
Licensing Program Analyst (LPA) Blanca Ruiz arrived at the facility to conduct a Case Management Inspection for the purpose of addressing a separate matter discovered during a complaint investigation. LPA met with New Facility Director, Misha David, Licensee, Yanping Zhang (Ella) and licensee daughter, Yeran Zheng ( Alice) who translated this report in Chinese/Mandarin to provide the findings related to the above allegation. The facility was toured, and census was taken. Several unannounced inspections have been conducted on 08/09/23, 09/01/23 and 09/18/23. Per Title 22, licensee is required to provide sufficient staff in order to meet all children’s needs. On 09/01/23, LPA observed 13 children in care. Staff #1 was supervising two children at the entrance of the facility. 11 children were observed in a second classroom attempting to nap; 4 of them were fully awake and engaging in conversation and walking around the classroom.
No additional staff was in the classroom. Teacher to child ratio is 1:12. Staff #2 arrived later to assist with supervision. Then Staff #3 and Staff#4 arrived 30- 45 minutes later from an affiliated facility to assist children who required one-on-one attention. LPA was informed that facility director, Laura Perez is no longer working for the facility since the middle of 08/2023.
Information received throughout the investigation revealed that the licensee is aware of the out of ratio situations due to multiple staff changing schedule and/or lack of facility director present at the center. Closer supervision is also required to shadow multiple children(ren) with challenging behaviors. However, the facility failed to rearrange or add additional staff; as well as to work a plan to meet the needs of all the children in care.

Exit interview conducted and report was reviewed with Licensee, Yanping Zhang (Ella). A Notice of Site Visit and Type A Deficiency was given and must remain posted on, or immediately adjacent to the interior of the main door for 30 days. Appeal Rights discussed and given to facility representative, along with a copy of this report and LIC 9224 was given to the licensee or facility representative. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.


Upon receipt, the licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility for the next 12 months.

THIS REPORT MUST BE AVAILABLE TO THE PUBLIC, UPON THEIR REQUEST, FOR THREE YEARS.

Teacher – Child Ratio: There shall be a ratio of one teacher supervising no more than 12 children in attendance except as specified in (b) and (c). This requirement was not met as evidenced by: On 09/01/23 LPA observed 1 teacher ( Staff #1) supervising up to 13 children, momentarily for approximately an hour, until an additional staff arrived to assist.
LPA observed 13 children in care. Staff #1 supervising 2 children at the entrance of the facility while 11 children were observed in a second classroom attempting to nap;

The administrator agrees to ensure the facility is in ratio by ensuring there is a 1 to 12 Teacher - Child ratio at all times. Licensee also agrees to provide a detailed staffing plan as proof of adequate staffing for the number of enrolled children to Licensing by deadline.

LPA observed C1, C2 and C3 hitting each other and other children in care. Facility failed to rearrange staffing to ensure sufficient teacher/teacher aide(s) were present to meet the needs of the children in the class to protect the safety of children in care "This is an immediate Health and Safety risk for the children".
