Licensing Program Analyst (LPA) Rachel Zeron conducted an unannounced inspectionto continue the investigation and to deliver the findings of the above complaint allegation. A previous inspection was conducted on 04/28/2023 to initiate this investigation. LPA Zeron met with Director Gale Van Duzer and discussed the purpose of today's visit. During this visit, LPA interviewed additional pertinent parties, reviewed records, and conducted facility observations. The following was discuseed with the Director as a result of the investigation:
It was alleged that facility staff did not meet day care child's need for a clean diaper. A child was left in their diaper containing feces for approximately thirty minutes and the child left the facility with a diaper rash. LPA investigated the above allegation and gathered the following information. According to facility records, on or about 04/18/2023, while a child was in care, his/her diaper was checked three times throughout the day. According to facility records, the child was first changed at approximately 11:15am, wet diaper,then received a second changing at approximately 3:00 pm, wet diaper. The child received their last diaper check which the child was found to be dry at appoximently 5:15 pm, prior to being transferred to the combined classroom for a later pick up that did not have a changing table present. Responsible party arrived to pick up child at appoximently 5:51pm and found the child was soiled and the child had developed a diaper rash.

Based on interviews with pertinent parties, records reviewed, and interview disclosures, a child was left in his/her diaper for approximately thirty minutes and a rash a had developed According to interview disclosures, staff are required to check a child's diaper every two hours and staff are required to change a child every two hours whether a child has a wet or soiled diaper. Based on this information, the department has determined the preponderance of evidence standard has been met, the above allegation is found to be SUBSTANTIATED

LPA Rachel Zeron conducted an exit interview and provided a copy of this report to Director Gale Van Duzer. A notice of site visit was issued and shall remain posted for the next 30 days along with a copy of all TYPE A Deficiencies (LIC9099D) cited during this inspection.

A COPY OF ALL TYPE A DEFICIENCIES CITED DURING THIS INSPECTION MUST ALSO BE IMMEDIATELY (WITHIN 24 HOURS OF THE CHILD’S NEXT DAY IN CARE) GIVEN TO THE PARENTS OF ALL CHILDREN ENROLLED IN THE CHILD CARE FACILITY AND ANY CHILDREN ENROLLED INTO THE CHILD CARE FACILITY OVER THE NEXT 12 MONTHS (AT THE TIME OF ENROLLMENT). Appeal rights discussed, and a copy of this report was provided to Director Gale on this date.

Director agrees to have a meeting with staff on the importance of timely diaper change and how this is a violation of the child's personal rights. Director has put a new policy in place, the end of the day the 2 year old teacher will stay with the 2 year olds in the classroom to ensure that the children are

Licensing Program Analyst (LPA) Rachel Zeron arrived at the facility to conclude a complaint investigation in regard to the above allegations received by Community Care Licensing (CCL) on 04/19/2023. A previous inspection was conducted on 04/28/2023 to initiate this investigation. LPA were given access to the facility by the director, Margaret Gale Van Duzer. LPA discussed the purpose of today’s visit, took census, and toured the facility. LPA met with the director to further discuss the complaint allegations and deliver findings.

During the investigation, LPAs made observations, reviewed pertinent documentation, and conducted interviews with pertinent parties. It was alleged, Facility staff did not meet day care child's need for a drink of water.During observation, LPAs observed a water container in the classroom with plastic cups nearby for children to drink out of and dispose of after use. LPA also observed that children would need to ask for water, some children had access to their own water bottle that was brought from home. In the outdoor area, LPA observed a child drinking from the water fountain, which is available to daycare children.

Based on information obtained during this investigation and through interviews conducted, the review of pertinent documentation, and Interviews revealing conflicting information, the allegations are UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred.

An exit interview was conducted with the director, Margaret Gale Van Duzer . Appeal Rights were discussed and issued, a copy of this report was provided, and a Notice of Site (NOS) Visit was issued.

The Notice of Site Visit (LIC9213) shall be posted where the parent/guardian of children enter and exit the facility. The Notice of Site Visit (LIC9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00
