On February 8, 2024 Licensing Program Analyst (LPA) Rachel Zeron arrived at the facility to conclude the investigation regarding the above allegation. During the investigation, LPA toured the facility and took census.

On January 11, 2024, a complaint was received alleging facility staff are not preventing physical altercations between day care children and facility staff are not adequately supervising day care children. It was noted on three different days a child was involved in a physical altercation. It was also noted during the incidents there were staff near the incident who were not monitoring the children and did not stop the altercations. During interviews with pertinent parties, it was disclosed that the facility is always within ratio per the Title 22 regulations during the alleged incidents. Staff stated that they have observed children in the infant room hitting, pushing, biting and pulling but have never seen any children displaying these behaviors in an aggressive way or excessively. Pertinent parties also stated they have never observed any one child being involved in daily altercations. Staff acknowledged these types of behaviors are normal and developmentally appropriate for this age group.

Although these behaviors are developmentally appropriate, Staff stated they are constantly redirecting and encouraging positive interactions with friends. Director stated the facility does not have any written Ouch Reports due to there not being any injuries or any unusual behaviors occurring in the classroom.

Furthermore, it was noted that the facility was within ratio during the alleged incidents. During interviews with pertinent parties it was stated that the classroom where the alleged incidents occurred they always have four staff with an average of 14-16 children. The Director stated the only time the staffing in that room will be less than four is if the number of children is down and, in those cases, the extra staff will float around the facility to provide extra assistance to other classrooms. Pertinent parties confirmed the classes always have four staff. During a typical day, staff stated one staff will be in the table area, one staff will be changing diapers and two staff will be on the rug.

This agency has investigated the complaint regarding the above allegation. Based on the interviews conducted and documentation collected, the allegations are UNSUBSTANTIATED. A finding of unsubstantiated means, although the allegations may have happened, or are valid, there is not a preponderance of the evidence to prove the allegations occurred.

No deficiencies cited during this inspection.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Gale Van Duzer, Director.
