25 | On 10/22/2024 Licensing Program Analyst (LPA) Justin Giese made an unannounced visit to the facility for another purpose. LPA met with Met with Facility Director, Josiemarie Corino and discussed the following.
On 09/26/2024 LPA made an unannounced visit to the facility for another purpose. During this visit, LPA conducted interviews with Staff and reviewed pertinent documents related to another matter. It was disclosed in staff interviews/written statements that a child in care was physically separated after refusing to let go of another child’s arms. It was stated staff gave verbal redirection to the subject child, however; the child did not release their grasp of the other child's arms. Staff then physically separated the subject child away from the other child by pulling their arms away and embracing the subject child in a hugging manner by pulling the child close to their body. Staff then held the child and went to a seated position on the floor, placing the child into their lap, where they held them for an estimated period of one minute without free movement.
It was disclosed Staff’s actions were employed to de-escalate the situation and to calm the subject child down, in an effort to prevent them from grabbing onto other children.
The facility was found to be in violation of the following Title 22 regulation:
101223(a)(3) Personal Rights:
(a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment… or other actions of a punitive nature including but not limited to… physical functioning. See LIC809D for Type B Deficiency
An exit interview was conducted, A copy of this report and appeal rights were given to Facility Director, Josiemarie Corino during this inspection on 10/22/2024.
LPA issued a Notice of Site Visit and verified it was posted in a prominent location at the facility. Licensee understands that the Notice of Site Visit must remain posted for the next 30 days |
