Licensing Program Analyst (LPA) Rachel Zeron made an unannounced visit to 10 day visit for a complaint the regional office received on 07/13/2023. LPA met with Linglin He, Director. The following was alleged: Facility is operating out of ratio and Staff did not meet daycare child's dietary needs.

LPA reviewed records/documents, interviewed staff, and made direct observations of teacher to child ratios in all functioning classrooms. On both visits, the facility’s staff/child ratio was found to be in compliance. Interviews with pertinent individuals indicated that during nap time one teacher is left with up to 24 children and some of the children would not be sleeping just laying on their cot resting and occasionally get up off the cot and wander around the classroom. LPA directly observed adequate and qualified staff for the number of children and found the facility to be in compliance. Additionally, LPA interviewed staff, and based on those interviews, staff indicated that if the children are awake the children will remain on their cots and if they need assistance they can always call for help up at the reception area.
On today's visit, LPA observed children at nap time and found the children were on their cots during nap time either sleeping or resting. Due to conflicting information, LPA was unable to confirm the allegation at this time.

The second allegation alleged that staff did not meet child's dietary needs. According to the complaint, children that did not finish their food by nap time would be thrown away. LPA conducted interviews with pertinent individuals and children in care, interviews with staff indicated that teachers would save lunchtime food and for second snack but if it was a dairy product it would be thrown away due to possible spoil. Lunchtime is a 30 minute period and staff indicated that the children are given an additional 15 minutes if needed. Interviews with children indicated that if they are not done with food they would put the unfinished portion in their cubbies, others indicated that they have been told to throw away their food. Due to conflicting information, LPA was unable to confirm the allegation at this time.

Therefore, due to conflicting information found throughout this investigation this agency has investigated the complaints. Although the allegation may have happened, or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

A NOTICE OF SITE VISIT WAS GIVEN. DIRECTOR WAS INSTRUCTED TO POSTED IT IN A PROMINENT LOCATION AT THE FACILITY. THE DIRECTOR UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS.
