Licensing Program Manager (LPM) Claretta Yates and Licensing Program Analyst (LPA) Babatunde Ibitoye conducted an unannounced inspection at the Haney Family Child Care Home and met with Cassandra Haney (Licensee). The purpose of the inspection was to deliver the findings on an Unusual Incident that was reported on April 11. 2022. The licensee self reported that child #1 engaged in inappropriate sexual conduct with Child #2 that was not a day-care client. The incident occurred in the day-care home. The licensee was not present at the time of the incident. Present during the time of this inspection is licensee, adult assistant and 10 daycare children ages 6 months - 8 years old.

Base on the information obtained and child's #1 admission, there is a preponderance of the evidence to prove that child #1 engaged in inappropriate sexual contact and/or touching with child #2 at the facility which included child #2 being disrobed and instructed/made to sit on top of Child #1. The licensee allowed child #1 to be present in the home after submitting a written declaration that child #1 will not be at the facility during the hours of daycare operation. It was reveal that the licensee allowed C1 to be present in the home while providing daycare services. It was also revealed that the licensee operated outside of the facility's stated hours of operation, risking child #1 to having access to childcare children. This is a violation the Health and Safety Section 1596.885(c): Conduct Inimical.

This requirement was not met by LPAs observation, interview, file review that On or about April 11, 2022 child #1 sexually abused child #2 who is not a day care client. Also the licensee allowed child #1 to be present in the home while childcare children were present and licensee operated beyond the operation hours indicated on the facility license. This poses an immediiate risk to the Health and Safety of children in care.
