  • On 2/14/2023, Licensing Program Analyst’s (LPA’s) Kris Diaz and Carol Heath conducted an announced Pre-Licensing inspection with applicant, Brittany Faria to ensure the facility meets basic licensing requirements set forth by Title 22, Health and Safety, and statutory requirements. The applicant is requesting to provide care for a small family childcare home with a capacity of 8 children. LPA toured the house in and out to ensure it met FCCH requirements. During today's inspection, the applicant was home alone. Applicant has two dogs. One is the family pet and the other is a dog the applicant is rehoming.

· Hours of operation: are 6:00am – 6:00pm The Incidental Medical Services (IMS) policy was discussed. The provider will provide as needed and will notify LPA when children needing this plan are enrolled.

The home is described as follows:

· This is a 1 story home that consists of 3 bedrooms, 2 bathrooms, a kitchen, a living room, a garage, and two backyard areas. Backyard area #1 will be used as a play area for children at a later time. Backyard area #1 and backyard area #2 is off-limits. The home has central heating and air conditioning. All windows are free of cracks, bugs, and debris. Hanging window blinds cords are inaccessible to children. The off-limits areas are Garage, Kitchen, Master Bedroom, Bedroom 2, Bathroom #2, and the Backyard areas #1 and #2.


· Indoor:
· Main area: Main care is provided in Bedroom 1, Living Room, Dining Room, and Bathroom #1. Children use the bathroom down the hallway. Children will not have access to the backyard at this time.
· Bedroom #1: Is set-up as the main childcare area. LPA observed many age-appropriate toys, books, and other materials.

 Living Room: There is a fireplace located in the Living room, and it is screened. The screen needs a lock to make it inaccessible to the children. Per the applicant, the children will nap in the Living Room.
· Bathroom #1: Children will use bathroom #1 next to the Living Room. Bathroom #1 was toured, and inspected the toilet is in operable condition. The faucets are clean, safe, and operable; the bathtub and shower area are free of hazards. No medications were observed in the bathroom.
· Kitchen: All sharp utensils, cutlery, cleaning supplies, medicines, drawers, cabinets with plastic bags and pointy things are accessible to the children. LPA informed applicant that these materials need to be in locked cabinet out of reach of children and made inaccessible to children. The refrigerator, dishwasher, stove, microwave, etc., are clean. The refrigerator has medications that need to be moved and made inaccessible to children. LPA informed applicant that correction need to be made. The kitchen was clean, orderly. Medications are accessible to children. LPA informed applicant that correction needs to be made by moving medications to a location that is inaccessible to children.
· Dining: The area was clean. Applicant will use the dining area to feed the children and will serve breakfast, lunch and snack. LPA observed 1 high chair, 5 small chairs for children, 3 dining table chairs and one dining table and 1 small table for children.
· Outside:
· Backyard #1: The backyard was inspected. The backyard is completely fenced. The backyard is completely off-limits to the children at this time. Applicant will use the backyard for outside play when she makes necessary repairs and the dog that is currently housed there is removed. There is an outdoor patio that is off-limits to children. The door that leads to the backyard needs to be made inaccessible to children. The backyard was inspected; the backyard is not clean and free from all debris. There is NO body of water on the premises. Children will not play outside as the backyard is not free from hazards. LPA reminded applicant to contact when the backyard is repaired and made accessible to children.
· Off-limit area:
· Bedrooms (Safety door knobs or key lock): The master bedroom, Bedroom #2 have safety door knobs to make the room inaccessible to the children. Applicant informed no weapons in the home.
  • Garage (safety door knob): LPA inspected the garage. According to the applicant, the garage is off-limits for the children. No childcare activities will be conducted there.

o Bodies of water: There is NO pool (body of water on the premises) in the home.
o Cleaning compounds are stored in the kitchen under the sink. They are not inaccessible to children and need a lock on the cabinet.
o Electrical outlets: All unused electrical outlets are plugged in and made inaccessible to children.
o Fire extinguisher (2A10BC) LPA observed there is a required fire extinguisher (2A10BC) fully charged and located in the hallway close to the main childcare area and living room inaccessible to children. It meets standards established by the State Fire Marshall.
· Hanging window blind cords: The cords are inaccessible to children.
· Incidental Medical Services (IMS): Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to the publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm. The applicant will be providing IMS to the daycare children.
· Isolation area (Illness): Per the applicant, if the child shows signs of illness, he/she will be separated from other children and stay in the living room in an isolation area until parents can pick up.
· Medications and cleaning solutions: Detergents/cleaning compounds are under the kitchen sink and does not contain a lock making it accessible to children. Medications are in kitchen in an upper cabinet and liquids are stored in the refrigerator accessible to children.
· Meals: The applicant will provide Breakfast, Lunch, and snacks
o Napping equipment (Mats or cots): LPA observed 6 cots, 2 mats and 1 playpen. Per the applicant, children will nap in the living room.
· Pets: 2 small dogs. Per applicant, the dogs do not have current vaccinations
· Phone service: There is 2 cell phones.
· Smoke Detectors and Carbon Monoxide: The smoke detectors and carbon monoxide devices were tested and in operable condition.

· The First Aid kit is located in the hallway storage area near the main childcare area and living room locked and inaccessible to children. The First Aid Kit was observed to be complete with supplies. LPA reminded applicant to get a first-aid manual.
· Transportation: The applicant will NOT transport daycare children.
· Weapons or Firearms: Per the applicant, there are NO firearms at the home at this time.
· Documentation:
· The applicant has current CPR, and First Aid Training with the expiration dates of 2/2024 and Prevented Health and Safety Training completed: on 5/2/2021. The applicant has her fingerprint clearance and TB exam. The applicant has proof of being immunized against influenza, pertussis, and measles. The applicant has proof of Mandated Reporting Training dated 5/10/2021. LPA shared LIC 311D with the applicant.

· The following was discussed with The applicant:
· Mandatory Forms for the children's files and provider's files, Requirements for fire drills, earthquake drills, and documentation for both. Role and responsibilities of being a mandated reporter.

· The applicant was reminded that 100% supervision is required at all times for children in care. The applicant was advised how to access forms and Regulations for Family Child Care online at www.ccld.ca.gov. The applicant was made aware that it is he/her responsibility to know the regulations as well as anyone who assists in providing care. Licensing must have the facility's phone number at all times; if the phone number is changed, licensing must be notified


· The regulation prohibits the smoking of tobacco in a private residence that is licensed as a family childcare home and in those areas of the family daycare home where children are present (24/7 ban). State law prohibits baby walkers, bouncy seats, exersaucers, and any other items that fall into that category.
· On January 1, 2018, or before March 30, 2018, a person who is a licensed childcare provider, administrator, or employee of a licensed child day care facility shall complete the online mandated reporter training and shall complete renewal mandated reporter training every two years. @www.mandatereporterca.com
· Senate Bill AB 633 - Child Care Facilities: Parent Notification Requirements
· Summary: This bill amends Health and Safety Code (HSC) sections 1596.859, 1596.8595, 1596.8895, and 1597.05 to improve the transparency of licensing records and to ensure that parents/guardians using a licensed childcare facility are aware of situations that present the greatest danger to children.

· Per the Health & Safety Code §1596.846 (b) and (c); states that a baby walker shall not be kept or used on the premises of a child day care facility. The California Code of Regulations, Title 22, Division 12, Chapter 3, Section 102417 (g)(10), under Operation of Family Child Care Home; states that a baby walker shall not be allowed on the premises of a family child care home. Legislature declared that a baby walker or item of similar nature are considered an immediate risk to the child's safety as they are inherently unsafe and not capable of design changes that would or prevent accidents
· §1597.622 Employees or volunteers at a family day care home; immunization requirements; records; exemptions (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year

**As a result of this inspection, the home does not meet Title 22 Regulations. Corrections are required by February 21, 2023.

· The front door needs a security door knob to make it inaccessible to the children.


· Kitchen cabinets that contain medications, cleaning supplies, and other hazardous materials need a lock to make them inaccessible to children. The applicant will make sure the knives and sharp objects are inaccessible to the children. LPA reminded applicant to make all medications inaccessible to the children.
· The lamp in the corner of the living room poses a risk of falling on the children. LPA reminded applicant to place it area inaccessible to children.
· The fireplace screen needs a safety latch to make it inaccessible to the children. LPA reminded applicant to supervise children around brick fireplace.
· Fan in living room behind chair needs to be relocated to make it inaccessible to children.
· Table in living room needs safety latch relocated.
· Television and stand in living room needs to be secured
· Wall behind front door needs to be repaired.
· Window in main day care area needs to be secured.
· Forms to be relocated near front door for parents access.
