On 02/14/2023 Licensing Program Analyst (LPA) Beneroso conducted a subsequent complaint inspection for the purpose of delivering the findings of the above allegation. Upon arrival, LPA met with Jennifer Morris, director.

The investigation was conducted by the Department’s Investigation Bureau, Investigator Georgina Tallagua. The investigation consisted of interviews with all complaint relevant parties, law enforcement and documents related to the complaint.

Allegation One: Based on information received it was determined that on or about 9/29/22, during nap time, there was lack of visual supervision of children resulting in the inappropriate contact between child #1 and child #2. The supervising teachers did not observe the incident.

Based on the information obtained from the interviews conducted, the above allegations have been substantiated based on a preponderance of evidence. An immediate civil penalty in the amount of $500 dollars was assessed as of result of the absence of supervision.

The facility was cited Type A deficiencies as of result of the violations in accordance with Title 22 of the California Code of Regulations. Facility was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. A copy of the licensing report must also be posted for 30 days. The same report must be provided to parents/guardians of children currently and newly enrolled at the facility during the next 12 months and facility must obtain a signed Acknowledgement of Licensing Reports (LIC 9224) from parent/guardian and place it in each child's file. If these requirements are not met, civil penalties per violation will be assessed.


An exit interview was conducted, a copy of this report, a notice of site visit and appeal rights were provided.

Director shall provide LPA with a plan for care and supervision during nap time. The plan should entail a process to ensure children are observed at all times and provide training to all staff to prevent similar incidents reocurring in the future. The plan must be submitted to the depament no later than 02/15/2023.
