On April 5, 2023, Licensing Program Analyst (LPA), Kuliema Calloway met with Licensee for the purpose of conducting a 1 Yr. Required Visit for the Kids and Care Inc. The facility consists of four (4) classrooms, kitchen, staff room, office space, six bathrooms, and the outside play area. The Infant area occupies the first classroom on the left upon entry into the front door and has it has its own outside play area. Operation hours: Monday through Friday from 6:00 am to 6:30 pm.

The facility has telephone service, heating, lighting, and ventilation are all adequate. There are cubbies for children's belongings inside the classroom. LPA observed age-appropriate toys, books, and furniture. Drinking water is available inside the classroom in the form of a water dispenser and personalized cups. There is a fire alarm, carbon monoxide detector and smoke detector located inside the classroom. The fire extinguisher is full and was serviced March 2023, it is located near the front door entrance on the wall. All electrical outlets inside the infant room were covered. LPA observed a fully stocked first aid kit; fully charged fire extinguishers and carbon monoxide detectors and smoke detectors throughout the center.

The facility provides breakfast, two snacks, and lunch. Menus are posted outside in the window in front of the day-care. LPA observed an appropriate amount of food and snacks inside the kitchen. Cleaning solutions and other chemicals are kept in the cabinet underneath the kitchen sink and the kitchen is not locked and is accessible to day care children. LPA advised licensee to make the chemicals inaccessible or provide supervision at all times for this area.

LPA inspected the bathroom inside the infant room. It was used as a storage area and was not utilized for restroom use. The toilets and sinks are functioning properly and are age appropriate. There was no evidence of potty training for the infants they are in diapers. LPA observed soap, toilet paper, and paper towels readily available. The water temperature is appropriate. The staff restroom is outside down the hall.
Postings: The Emergency Disaster Plan, The Notification for Parents Rights poster and Personal Rights (LIC 613A) has the incorrect address for CDSS Regional Office. LPA reviewed the Earthquake Preparedness Checklist (LIC 9148), the current Fire/Earthquake Drill log, did not indicate the year the drills were conducted, and the facility Roster was current and made available.
Medication: The children are inspected for illnesses as they arrive. A review of medication policy indicated that prescription medication is administered only with the parent's written permission and physician’s recommendation. The Director administers medication and documents the dosage, date, and time on a log. Medication is brought and taken home by the parent daily. Medication is properly labeled and stored in its original container. There is one child in care with IMS needs on this site. LPA observed the parent consent form and a storage container labeled with the child’s name stored up high in a cabinet. Sign-in and Out Procedures: The center utilizes an electronic sign in and out procedure (Pro- Care Phone App) The Sign-in and out sheets were reviewed for full, legal signatures and the sign in and out time. The book was empty, but the center has the capability of producing hard copies if needed. Ratios: The teacher to child ratio was observed and staff names were recorded on a staff sign in sheet. Care and supervision were evaluated to determine if the basic needs of children are met and appropriate. LPA observed teacher reading and interacting with infant children both inside and outside on the playground.

Records: Children's records and teacher staff records were reviewed. Director records were available for review at the facility. LPA verified there is at least 1 staff person present with current CPR and First Aid Training (exp.9/2024). Mandated Reporter expires 1/7/2025.
Outside: The outdoor play equipment was inspected for health, safety, cushioning material, good repair, and age appropriateness. The infant play area has artificial turf and is fenced and away from the other age groups. There is an area for rest (canopy). A water dispenser and disposable cups are brought outside during play. The play area was inspected and found to be free of hazards and inaccessibility to bodies of water. The slide and swing set is made of hard plastic and is not anchored, but safe for the age group children to play. There are age appropriate bicycles and toys.
Napping: Bedding shall be individually stored so that each child's bedding is identifiable, and no child's used bedding comes into contact with other bedding. Each infant's bedding shall be used for him/her only. Bedding shall be changed daily, or more often if required. Mattresses shall be wiped with a detergent/disinfectant daily or when soiled or wet; crib mattress shall be maintained in a safe condition with no exposed foam, batting or coils. The isolation area will be in the front office area.

The following general information was discussed during this inspection:
The Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Mandated Reporter Training Requirements: §1596.8662 - As of January 1, 2018, childcare providers, administrators, or employees who work in a licensed facility shall complete the mandated reporter training provided according to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.

Immunization Requirements: §1596.7995 (a)(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a daycare center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year.

Fingerprint clearances and transfers: Before working or volunteering in a licensed childcare facility, all individuals subject to a criminal record review shall obtain a clearance or criminal record exemption. If a fingerprint clearance has been obtained through the Department, Licensee may request a transfer of a criminal record clearance from one state-licensed facility to another using form LIC 9184


**Each report (documenting a Type A citation) shall remain posted for 30 days along with the Notice of Site Visit (printed out during this inspection). In addition, all parents of currently enrolled children and any newly enrolled child for the following 12 months shall receive a copy of the report documenting a Type A Citation and sign form LIC 9224 acknowledging receipt. Staff is aware of the required forms for children's files.

**Senate Bill AB 633 - Child Care Facilities: Parent Notification Requirements

Summary: This bill amends Health and Safety Code (HSC) sections 1596.859, 1596.8595, 1596.8895, and 1597.05 to improve the transparency of licensing records and to ensure that parents/guardians using a licensed childcare facility are aware of situations that present the greatest danger to children.

There are three Type B Deficiencies Cited during this inspection. Per Title 22, Division 12, Chapter 1 for 101217(a)(6), and Per HSC 1596.7995 (a)(1) and 1597.16. and two Technical Advisories. See 809D pages.
