THIS REPORT IS AN AMENDED REPORT TO THE ONE GIVEN TO THE FACILITY ON 07/18/2024.
On July 18, 2024 at 10:00 a.m., Licensing Program Analyst (LPA) Zirbes met with the Facility Representative, Jennifer Batts. The purpose of the inspection was to conduct an unannounced annual/random inspection. During the inspection, LPA toured and inspected the Infant program in accordance with the facility sketch. LPA observed a total of three infants, with one teacher providing supervision at the time of the inspection. The infant area consists of one room and an outdoor activity space. The center also operates an School Age Program (#367750055) and Preschool Program (#367750054). The center operates 7:00am -6:00pm, Monday through Friday.
Indoor/Children's Area: Indoor activity space for infants is physically separate from space used by children in the preschool and school-age child care center components. Infant center is equipped with appropriate furniture and equipment, changing table and feeding table. Furniture is maintained in good repair and safe condition (age appropriate). LPA did not observe sharp points or edges, or small parts that could be swallowed. Per staff interviews equipment, toys and furniture are sanitized daily. There is one hand washing sink within arms length of the changing table. No infant is left without supervision (visual), nor left unattended. At the time of this inspection, the facility was in compliance with the staff/infant ratio and is not exceeding the approved capacity for the facility.
Furniture and equipment were inspected for age appropriateness and good repair. Based on LPAs observations the toys and equipment were in good repair at the time of this inspection. There is a Infant Daily Report which documents the times the infant napped, time of diaper changing and what the infant ate. Report is completed each day by the staff. Used diapers are put in a trash can in a cabinet which is stored near the changing area. Each infant has container labeled with their name for the storage of personal items.

LPA observed the cleaning compounds were stored on a high inaccessible shelf in the classroom. The infant center does not have a fire place. The building has central heating. The building does not have air conditioning however has ceiling fans are in the room. The room temperature was comfortable at the time of this inspection. LPA observed combination carbon monoxide and smoke detectors in the center along with Fire Extinguishers. There is a working telephone on the premises. There is an isolation room for ill children. The facility maintains electronic sign in and out records. Based on LPA review the sign in/out sheets were current and accurate.

No smoking is allowed on the premises. LPA did not observe baby walkers or other prohibited play equipment on the premises.

Napping: LPA observed cribs and cots. LPA observed the crib mattresses were made of a cleanable vinyl material and were in good repair. The sleeping area is separated from the infant activity space. Sheets are cleaned and changed everyday or more often as necessary. LPA reminded the Center that a infant care aide shall work under the direct supervision of the director, the assistant director or a fully qualified teacher.
Other: Electrical outlets are inaccessible, there are no recalled and or prohibited toys or sleep/play equipment observed on the premises.
Restrooms: At this time all infants are in diapers the infant area does not have a bathroom. A diaper changing area was located in the infant sleeping area. The area was clean and sanitary during this inspection.
Outdoor: Outdoor play equipment was inspected for health, safety, good repair and age appropriateness. The outdoor play area is enclosed by a wrought iron fence. One three foot section of the outdoor activity area fence was three feet in height instead of the required four feet height. LPA advised the Licensee to make the required corrections to the fence height within the next 30 days. LPA observed a small climbing structure placed on sand. The climbing structure was secured to the ground. An umbrella was present to provide a shaded rest area. The teachers take water and cups to the outdoor play space for the infants. LPA observed approximately 6 red ants in the outdoor activity space when the area was inspected at approximately 11:00 am. LPA advised the Center to monitor the area for the ants. LPA observed the wooden picnic table top had a rough areas that pose a potential risk to the infants in care. A type B citation was issued.

Infant File and Staff File Review: LPA reviewed a total of 3 infant files and three staff files. Per LPA review, Child 1 (C1) needs and service plan was completed in 10.10.2023, and zero documentation was present showing an updated plan. Staff 1 confirmed there was zero additional paperwork for C1. Based on LPA review one of three infant files reviewed did not have an updated needs and service plan updated at least quarterly. A technical violation was issued. Per LPA review of the 15 minute safe sleep checks, the staff initials of the person who conducted each check was not documented on the following dates: July 1, 2024, July 2, 2024, July 15, 2024, July 16, 2024, July 17, 2024. LPA reviewed additional dates and observed the staff were initialling each 15 minute check. A type B citation was issued. LPA reviewed three staff files. Files contained the required documentation.
Facility Records
LPA and Facility representative reviewed the LIC 311A Records To Be Maintained At The Facility.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.
For child care center licenses issued after July 1, 2022, the licensee shall test their water for
lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-
CCP).
LPA verified that the lead testing was completed in accordance to the Written Directives
outlined in PIN 21-21.1-CCP.
Postings:
The following were observed posted as required: facility license, Personal Rights (LIC613A), Parent’s Rights Poster, car seat law (PUB 269), emergency disaster plan.
Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. Licensee was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated..

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/

safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A notice of site visit was given and must remain posted for 30 days.Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee Lisa Burtner.
