32 | Interim Director stated that the incident occurred during the transition of children from the bathroom adjacent to the classroom to the playground area. C1 was recovered from the classroom by Staff (S1) and was observed to be safe and unharmed.
A review of facility sign in/sign out sheets and related documentation provided evidence that C1 was left without supervision inside of the classroom for approximately 15 minutes.
Based on Interim Director’s own admission, interviews with staff, facility sign in/sign out sheets and related documentation, the preponderance of evidence standard has been met and the allegation that staff left daycare child unattended is therefore SUBSTANTIATED.
Based on interviews and documentation, one (1) Type A deficiency of California Code of Regulations, Title 22, Division 12, Chapter 1, is being cited on the attached LIC 9099D.
LPA informed Interim Director, Nancy Betancourt that this report dated 9/4/2024 documents one (1) Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
An immediate civil penalty of $500 was assessed for absence of supervision.
Also, LPA informed Interim Director, Nancy Betancourt to provide a copy of this licensing report dated 9/4/2024 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA provided Interim Director, Nancy Betancourt with form LIC 9224.
Exit interview was conducted with Interim Director, Nancy Betancourt and a copy of this report and Appeal Rights were provided. A notice of site visit was given and must be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
