On July 13, 2023, at 10:04 a.m., Licensing Program Analyst (LPA) Cindy Hamilton, met with Balderrama Child Development Center’s (CCC) Director Andrea Yates to deliver the findings for the above stated allegation.   LPA Hamilton conducted a health and safety inspections of the CCC on June 8, 2023, and no safety concerns were noted.  During the investigation, LPA Hamilton conducted interviews with four staff, four children and program director. LPA also obtained and reviewed pertinent documentation.

On May 1, 2023, Community Licensing (CCL) received information stating staff threatened day care child(ren) while in care. It was alleged that a staff threatened a child stating the fire is going to get the child if the child did not behave and it was also alleged that a staff threatened a child(ren) with puppets while in care. Confidential interviews resulted in conflicting information being provided to LPA. Confidential interviews revealed to LPA that there were no witnesses to the staff in question threatening, intimidating or scaring any child(ren) in care with or without a puppet; whereas a confidential interview disclosed that the staff in question was observed showing a child a puppet and the child got scared.

Additionally, the same confidential interview disclosed that the staff in question gives children an intimidating stare, says the child’s name and then the child does what the staff says. Confidential interviews also disclosed the staff in question did tell the children in one of the classrooms a story about a fire that occurred after hours near the CCC but the children enjoyed the story and were not at all scared or intimidated by the staff or story. Another confidential interview disclosed that the staff in question does have a voice that is firm but not in a threatening manner.

Based on confidential interviews, the allegation that staff threatened day care child(ren) while in care, may have occurred, however is not supported or proven by evidence. Therefore, the allegation is unsubstantiated.

An exit interview was conducted, a copy of this report, appeal rights and Notice of Site Visit were provided to Director. The director was reminded that the Notice of Site Visit must remain posted for 30 consecutive days.
