***This is an amended report, delivered to the facility on 09/24/2021

Licensing Program Analyst (LPA) Otsanya Cameron arrived at the facility to amend the findings for the above referenced allegation. LPA conducted COVID-19 screening questions prior to entry. LPA met with the Director Natalie Swisse.

There is an allegation that Staff are not following Covid-19 mandates. The following was observed:
At 7:01am LPAs observed in classroom 2, a total of 10 children in the classroom with 3 staff. Five (5) School- aged children were eating breakfast at a table with 2 staff, and five (5) children playing at a separate table. Of these 5 children, 3 were preschool and 2 were school-aged and 4 of the 5 children playing were not wearing masks.

Between 7:10am and 7:30am LPAs observed several staff and children entering the facility where appropriate COVID-19 screenings were not conducted.

At 7:24am LPAs observed 3 Toddlers in room 5, ages 2.6yo, 2.7yo and 2.5yo in the classroom without face coverings, as this license has a toddler component. On or about 8/30/2021, a child in care tested positive for COVID-19 (see LIC809 dated 9/1/2021).

Based on LPA’s observation and interviews conducted, even after a child in this program tested positive for COVID-19, some children are not wearing face coverings and staff did not encourage children to wear face coverings upon entry or in the classrooms as required. This poses an immediate threat to the health and safety of the children in this facility. The preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED.

An exit interview was conducted, and a copy of this report was reviewed with and appeal rights provided to Assistant Director Lizbeth Perez-Uribe whose signature on this form confirm the above-mentioned documents.
A NOTICE OF SITE VISIT WAS ISSUED AND LPA VERIFIED THAT IT WAS POSTED IN A PROMINENT LOCATION AT THE FACILITY BEFORE LEAVING. THE LICENSEE UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS ALONG WITH A COPY OF ALL TYPE A DEFICIENCIES (9099D) CITED DURING THIS INSPECTION. A COPY OF ALL TYPE A DEFICIENCIES CITED DURING THIS INSPECTION MUST ALSO BE IMMEDIATELY (within 24 hours of the child’s next day in care) GIVEN TO THE PARENTS OF ALL CHILDREN ENROLLED IN THE CHILD CARE FACILITY AND ANY CHILDREN ENROLLED INTO THE CHILD CARE FACILITY OVER THE NEXT 12 MONTHS.

Director will generate a letter to staff and parents (current and future enrolled) informing them of the facility's approach to face coverings in accordance with the CDPH guidance.

On 09/1/21, Director Natalie did not completely ensure the personal rights of persons in care to safe and healthful accommodations and engaged in conduct inimical to the health, welfare, and safety of persons in care, in that children did not wear face coverings while in the facility, as required by the CDPH Guidance

on the use of face coverings issued July 28th 2021 and an individual masks exception does not apply. Additionally, an appropriate COVID-19 symptom screening of staff reporting to work and children upon arrival, to prevent entry of possible infected persons, was not conducted prior to entry at the facility.
