On May 18, 2023, at 10:05 AM, Licensing Program Analyst (LPA) Cindy Hamilton met with Children’s Paradise Vale Terrace (CCC) Assistant Director, Angelica Mondragon and Diana Prospero, Director of Child Development to deliver the findings of the above allegation. During the investigation LPA Hamilton obtained copies of pertinent documents from facilityfiles. LPA also conducted interviews with staff and reporting party.

On March 20, 2023, Community Care Licensing (CCL) received information stating Staff do not ensure the facility is in good repair. It was alleged that there is water leak in the ceiling in Room #2 that was initially noticed on March 13, 2023, again on March 17, 2023, and March 20, 2023. The ceiling tile looked as if it were going to burst, and staff was placing napping cots underneath the bulging ceiling tile. It was also alleged for the last month or so one of the toilets used by Room #2 does not flush and there is only one toilet for three classrooms. It was also alleged that children had to wait in line and are having many accidents while waiting to use the restroom.

Per Assistant Director and Director of Child Development CCC is awaiting delivery of new toilet and once toilet arrives it will be installed and video sent to LPA via email on or before the POC due date. CCC will also provide LPA written plan for Rooms 2 &4 bathroom usage no later than COB 5/19/23.

Based on observation and confidential interview with director it was confirmed that toilet closest to the wall in the bathroom between Rooms #4 & #2 does not flush.

Based on records review and confidential interviews, the CCC’s roof had a leak causing the tile(s)in Room #2 to bulge, leak and be discolored. The CCC continued to utilize the room and have children and visitors present.

Regarding the ceiling leak, Director provided LPA with pictures of the ceiling showing multiple water-stained ceiling tiles and the work orders to have the ceiling tiles replaced. Confidential interviews and records review disclosed that ceiling tiles were wet and observed to be leaking intermittently in Room #2 since mid-February. This issue had been brought to the attention of the Director and the Assistant Director and someone was supposed to come out and look at the ceiling. Confidential interviews also disclosed that ceiling tile was observed to be wet, bulging and stained multiple times before being properly fixed. Director also stated that the ceiling was fixed on the evening of Friday, March 17, 2023, but it rained over that weekend and on Monday, March 20, 2023, the ceiling tile was leaking and bulging again. Staff placed buckets and blankets underneath the leaking tile(s). Confidential interviews revealed to LPA that the facility continued to conduct class and children continued to nap in this classroom; whereas other confidential interviews disclosed the children were not allowed to nap or play under the bulging, wet ceiling tile(s). During LPA’s inspection on March 22, 2023, LPA observed the ceiling tiles had been replaced and Director stated the repairs to the roof and ceiling were completed about 10am on March 20, 2023. Director also stated there was no evidence of mold, mildew or smell in the classroom per maintenance or that she observed. Director provided LPA with documentation showing the Director noted the ceiling tiles needed to be repaired on January 10, 2023, and March 15, 2023 and Assistant Director submitted request to maintenance to have the ceiling tile(s) replaced on March 17, 2023.

Regarding the toilet not flushing in the bathroom between Room #2 and Room #4, LPA was present at the CCC on March 22, 2023, and observed the toilet closest to the wall not working. Per document review, Director provided LPA with documentation showing the CCC has been having problems with this particular toilet since October 2022. The most recent request for maintenance on the toilet was submitted by Assistant Director dated March 15, 2023, still has not been resolved as of May 16, 2023 per conversation with Director. Director also stated that facility is working on totally replacing the toilet but is not aware of a purchase order for a new toilet. On this date, LPA observed toilet to have tape across the seat so that it is not used by children in care due to toilet still not operative.

Based on confidential interviews, records review and observation, the preponderance of evidence has been met and the allegation that staff do not ensure the facility is in good repair is substantiated. The facility is being cited for Title 22, Section 101239( e)(4) Fixtures, Furniture, Equipment and Supplies and Section 101238(a) Building and Grounds which poses a potential health and safety risk to children in care.

An exit interview was conducted, this report, appeal rights and Notice of Site Visit was explained and provided to Assistat Director. Assistant Director was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
