On January 12, 2023, at 9:38 AM, Licensing Program Analyst (LPA) Cindy Hamilton met with Learning Jungle Valley Center (CCC) Director, Brittany Keegan to deliver the findings of the above allegations. On October 4, 2022, LPA Hamilton conducted a health and safety inspection of the facility and no immediate concerns were noted. During the investigation copies of pertinent documents were obtained from children and facility files. Also, interviews were conducted with three staff, and reporting party. LPA attempted to interview Adult #1 (A1) who witnessed an alleged incident, but LPA did not receive a call back and later was unable to leave messages.

On September 28, 2022, Community Care Licensing (CCL) received information stating staff does not provide appropriate supervision to children in care and staff handled child in a rough manner. Regarding the allegation that staff does not provide appropriate supervision to children in care, it was alleged that Child #1 (C1) was bitten by another child while in care and the CCC was not aware until parents inquired. It was also alleged that C1 exited the CCC and was unattended in the parking lot.

LPA Hamilton observed the CCC to be utilizing the appropriate staff to child ratio as regulated in Title 22. Confidential interviews revealed C1 would attempt to open the doors to the classrooms throughout the day. C1 successfully opened a door on one occasion when the teacher who was sitting by the door turned to assist another child but C1 was quickly retrieved. Confidential interviews and records review revealed C1 was bitten twice by other children and both incidents were observed and documented by teacher. Records review and confidential interviews also revealed that the lead teacher was on break when C1 was picked-up and parent did not receive information regarding the incident.

In regard to the allegation, staff handled C1 in a rough manner, it was alleged that on September 20, 2022, A1 witnessed a staff member “snatch” C1 off the slide. This staff member was not identified by name. Confidential interviews resulted in conflicting information being provided to LPA. A confidential interview disclosed to LPA that A1 witnessed C1 being “snatched” off the slide; whereas other confidential interviews disclosed that no one has witnessed or been advised of any children being handled in a rough manner or "snatched" off a slide.

Based on confidential interviews, observation and records review, the allegations that staff does not provide appropriate supervision to children in care and staff handled child in a rough manner, may have occurred, however are not supported or proven by evidence. Therefore, the allegations are unsubstantiated.

A copy of this report, appeal rights and Notice of Site Visit were provided to Director. Director was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
