Licensing Program Analyst (LPA), Kelli Waters, made a subsequent unannounced complaint investigation visit to deliver the findings for the above referenced allegation. LPA toured the facility, conducted a census and met with Jessica Feliciano, Director who was informed of the decision rendered.

It was alleged that staff handled day care child in a rough manner and yelled at children in care. It was also alleged that the facility has incomplete files, allowed uncleared and unqualified staff to provide care and supervision to day care children, and that the facility did not report an incident. During the investigation, LPA Waters conducted a record review of both staff and student files, a Guardian clearance employee review, facility inspection and interviewed staff.

Regarding staff handling a child in a rough manner and yelling at children in care, LPA Waters conducted confidential interviews. During interviews, LPA was unable to corroborate allegations that staff handled children roughly or yelled at children in care. Therefore, based on investigation findings, LPA Waters could not confirm the allegation of any adult yelling at children while in care.

Regarding the allegations of the facility having incomplete files and having unqualified and uncleared staff providing care and supervision to day care children, LPA completed a comprehensive file review of the facility, both for staff and children on 07/30/24. During review, LPA Waters found all children’s records to be complete and all staff qualified for their respective positions. LPA Waters also verified that all adults listed as employees of the facility had a cleared background with Guardian as of the date of record review.

Regarding staff not reporting an incident, interviews revealed that staff provide parents with an ouch report which is reviewed by administration and signed by a parent and kept in the child’s file. The facility also uses a third-party communication application, “Brightwheel”, to send pictures and communicate injuries with parents, if necessary. LPA conducted a review of the app and its messages between staff and parents and did not observe any reports indicating any incident or injuries that were not documented on the facilities written “ouch” reports kept in their files. Interviews and record review confirmed that the facility is following policies found in the facility’s staff and parent handbooks.

Although the allegations listed above may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.

An exit interview was conducted.

A Notice of Site visit and a copy of this report was provided to the facility.

This report must be made available for public review for 3 years upon request.
