On 8/30/23 at 12:15 PM Licensing Program Analyst (LPA) Adrian Mangina conducted an unannounced Annual inspection with the Licensee, Dina Guerra. Also present in the home was assistant Maria Estela Ariaga and nine children in care. LIcensee's husband Jose Cardenas and two minor children arrived between 1:15 PM and 1:30 PM. Appropriate supervision and ratios were observed. The two-bedroom two-bathroom single story home was toured and inspected to ensure an environment safe for the care and supervision of children. A review of records indicated that all adults who are required have fingerprint clearances associated to the facility. Licensee has provided lease as proof of control of property.Because the Licensee rents the home, proof of landlord notification is required. The LPA observed the Property Owner/Landlord Notification form (LIC9151) that the applicant confirms was provided to the property owner/landlord. The applicant obtained a signed Property Owner/Landlord Consent form (LIC 9149).

Licensee’s First Aid and CPR certifications expire 9/2023 and mandated reporter training expires 6/2/25 Assistant’s First Aid and CPR certifications expire 11/2024 and mandated reporter training expires 11/14/24. LPA reviewed a sample of child files which were complete. Last disaster drill was 3/2/23. LPA provide safe sleep regulations.

Licensee has provided adequate space for the children to eat, sleep and play within the home. The following areas are used for day-care: kitchen, living room, dining area, laundry room, hallway bathroom, bedroom, front and back yards when used with adult supervision. Off-limits areas include master bedroom and master bathroom. Fireplace in Living room is screened. There is a working fire extinguisher rated 2A10BC, smoke and carbon monoxide detectors are present and operational. Poisons, cleaning compounds, medications and other hazardous items are inaccessible to children using cabinet latches and/or placed in off limit areas. Adequate heating and ventilation are provided for day-care children. Children’s toys, play equipment and materials are available. Licensee states there are no firearms or weapons in the home. There are no bodies of water at time of inspection. Entrance Checklist was provided to the applicant.

Provider is hereby reminded of the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms, ensure that all adults living or working in the home have criminal background clearances associated to the facility, corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers are not allowed in day care. All equipment that is used should be used only as intended by the manufacturer. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov. LPA Mangina directed Licensee to website: https://www.cdss.ca.gov/inforesources/community-care-licensing to receive important updates and information.

LPA discussed the safe sleep regulations with Licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

On this date, 8/30/23, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. Exit interview conducted and report was reviewed with the Licensee, Dina Guerra. A notice of site visit was given to Licensee and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
