Licensing Program Analyst (LPA), Jennifer Lott conducted an unannounced Annual Licensing Inspection. LPA was greeted at the front door by Licensee, Iktifa Altaie and granted entry after identifying herself and disclosing the purpose of her visit. Licensee's daughter, Maryam Altaie provided translating services as the licensee's primary language is Arabic.

The licensee is using the following areas for daycare: Living room, dining room, kitchen, bedroom #2, bathroom #2, bedroom #3, front yard. Off limit areas include: Bedrooms #1, #4, #5, garage and garage room, back yard and pool. The facility currently has 4 children in care of which 2 were infants. Licensee is operating within the licensed ratio and capacity.

At 12:00pm, LPA tested the carbon monoxide detector, smoke detector and fire extinguisher located in the kitchen and hallway area. All devices were functional. There are no weapons or ammunition stored in the home. No stairs, fireplaces or open faced heaters in the home. Storage for poisons, detergents, cleaning solutions, medications are locked and inaccessible to children. The licensee could not advise when the last disaster/fire drill was conducted. The home is kept clean and orderly with heating and ventilation for safety and comfort. The home provides safe toys, play equipment and materials.

Children’s records were not complete. Pediatric CPR and First Aid cards are current and will expire on 04/2025. Immunizations were reviewed and are in compliance. There is a working telephone and email address.

Pool
Fencing is 5ft in height and does not obscure the pool from view. Pool gate swings away from the pool, but does not self latch. Opening between the railings of the fence do not exceed 4 inches. Bottom of the fence is no more than 4 inches from the hard-surfaced ground. One portion of the fence needs to be re-bolted to the wooden awning post. Fencing will remain place and properly functioning whenever there are licensed children in care. If fencing has not been repaired, then children are not permitted to use the back yard.

Safe Sleep
LPA discussed the safe sleep regulations with Licensee, Altaie and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Licensee, Altaie of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Criminal Record Clearance
Licensee, Altaie was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in health and Safety code section 1596.871, must obtain criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

No IMS
Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided:

Licensee, Altaie was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Based on today’s visit, deficiencies were observed and noted on the attached LIC 809D. Exit interview conducted and report was reviewed with Licensee, Altaie. During the exit interview, the Licensee, Altaie confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. A notice of site visit was given and must remain posted for 30 days.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Based on LPA's observatioins, the licensee did not comply with the section cited above in that the pool gates did not self latch and one portion of the fence not secured. Additionally, the back fencing gap needed to be blocked and pool equipment made inaccessible. This poses a potential health & safety risk to persons in care.
