32 | The facility currently has a fenced yard/playground for outdoor activities. LPA informed the licensee and director that children must be escorted to and from the playground, and that staff must maintain direct supervision at all times. The playground measured at approximately 1,791.61 sq. ft., sufficient for 23 children at one time. The outdoor play area is fully fenced and consists of an outdoor patio, two garden areas, grass lawn and cement side walk. Ms. Castaneda and Ms. Salon were advised that the sloped area of the grass lawn shall not be used for childcare. The licensee states that she will install a fence to separate the sloped area of the lawn from the usable space to ensure children do not have access to the sloped area. The licensee will barricade the utility meter located on the playground sidewalk. The licensee will also add shade to the portion of the grass lawn that will be used by the children. The licensee states that the separate elementary school program will utilize a nearby park and not the preschool playground for outdoor activities. Drinking water is readily accessible inside and outside the classroom. The licensee states that children will bring water bottles to the facility which staff will refill as necessary via bottled water. Ms. Castaneda and Ms. Salon were reminded that any changes to the facility must be reported to and approved by Community Care Licensing.

LPA reviewed with Ms. Castaneda and Ms. Salon the LIC 311A, Records to Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.
The licensee and director were reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.
