On November 6, 2023 at 1:30 pm, Licensing Program Analysts (LPA) Jessica Rubio and William Chancellor arrived unannounced to Discovery Preschool - Vista (CCC) and met with Owner Sally Chenoweth to deliver the investigation finding regarding the allegation listed above. On September 20, 2023 at 10:15 am, LPA Rubio opened the complaint investigation. During the investigation, LPA Rubio interviewed the Owner, Director (AD) and five former and/or current staff (S1, S2, S3, S4, S5). LPA also reviewed children’s files.

On September 19, 2023, a complaint was received alleging due to lack of supervision a daycare child was lost; specifically, that C1 was unknowingly left alone outside on the playground for an extended period time. Confidential interviews revealed there was an incident where C1’s class came into the CCC from the playground and C1 unknowingly remained alone outside. Interviews revealed once staff realized C1 was not inside C1 was found to be playing outside on the playground. Interviews revealed that C1 was left outside alone anywhere from 3 – 10 minutes during the incident.

Based on confidential interviews conducted during the investigation, the preponderance of evidence standard has been met and the allegation due to lack of supervision a daycare child was lost is substantiated. The facility is being cited for Title 22 Regulations Section 101229 (a) (1) Responsibility for Providing Care & Supervision. See LIC 9099-D for cited deficiencies. An LIC 9224 was provided and must be signed by parents as well as new enrollees for the next 12 months.

An exit interview was conducted, appeal rights were discussed, and a copy of this report was provided to Owner Sally Chenoweth. A notice of site visit was also provided and must remain posted for 30 days.

Center has already implemented a new set up/ process when coming into the facility to ensure all children are inside together. Owner also stated a training will be held with staff to address counting at transitions. Proof of training will be provided to LPA.

Based on interviews revealing that C1 was left unsupervised on the playground for 3-10 minutes which poses an immediate health, safety and or personal rights risk to children in care.

On November 6, 2023 at 1:00 pm, Licensing Program Analysts (LPA) Jessica Rubio and William Chancellor arrived unannounced to Discovery Preschool - Vista (CCC) and met with Owner Sally Chenoweth to deliver the investigation finding regarding the allegations listed above. On September 20, at 10:15 am, LPA Rubio opened the complaint investigation. During the investigation, LPA Rubio interviewed the Owner, Director (AD), five former and/or current staff (S1, S2, S3, S4, S5) and three children (C4, C5, C6). LPA also reviewed children’s files.

On September 19, 2023, a complaint was received alleging staff member handles daycare children in a rough manner and staff member yells at daycare children; specifically, that Director (AD) grabs and yanks children by their arms, places them onto mats roughly and yells at children. Confidential interviews with one former staff revealed that AD has been seen to yank children by their arms and/or pick them up and put them down roughly. Interviews with former staff also revealed AD has been heard to yell at children, however, no specific details of what AD has been heard to yell at children were provided. Other interviews with current staff revealed AD has not been seen to grab or handle children in any rough way.

Further interviews revealed, AD does have a loud voice and is stern, however, AD has not been heard to yell at children in a belittling or inappropriate way. Interviews with children revealed AD does not yell at or grab children in a rough way. AD stated she does have a loud voice, however, AD does not yell at children. AD also stated she does not grab or handle children in a rough manner, although AD will quickly grab a child’s hand or arm if AD is able to prevent a child from hitting or hurting another child.

Based on conflicting statements, the allegations that AD handles daycare children in a rough manner and AD yells at daycare children may have occurred, however is not supported or proven by evidence. Therefore, the above allegations are unsubstantiated. An exit interview was conducted and a copy of this report and appeal rights were discussed and provided to Owner Sally Chenoweth. A notice of site visit was also provided and must remain posted for 30 days.
