On November 6, 2023 at 2:00 pm, Licensing Program Analysts (LPA) Jessica Rubio and William Chancellor arrived unannounced to Discovery Preschool - Vista (CCC) to deliver the investigation finding regarding the allegations listed above. LPAs met with Owner Sally Chenoweth. On September 20, 2023 at 10:15 am, LPA Rubio opened the complaint investigation. During the investigation, LPA Rubio interviewed the Owner, Director (AD), five former and current staff (S1, S2, S3, S4, S5) and three children (C4, C5, C6). LPA also reviewed children’s files.

On September 19, 2023, a complaint was received alleging daycare child sustained unexplained injuries while in care; specifically, that on 2/28/2023, C1 sustained unexplained scratches to their face and body. The complaint also alleged that staff member handles daycare children in a rough manner, staff member yells at daycare children and staff member speaks inappropriately to daycare children; specifically, that AD grabs and yanks children by their arms, places them onto mats roughly, yells at children and has called a child a little sh*t.

Regarding the allegation that C1 sustained unexplained injuries while in care, record review revealed that on 2/28/2023, C1 did receive scratches on C1’s face caused by C2. Interviews also revealed that scratches had been seen on C1’s face and shoulder area that were caused by C2. Further interviews revealed that C2 did have behavioral incidents where C2 would grab and scratch, however, all interviews revealed that the facility was aware of C2’s behaviors and took steps to try to prevent C2 from injuring other children such as having a staff shadow C2 when staff were available, as well as informing C2’s parent of additional services and to cut C2’s nails. Record review revealed the ouch report for C1’s face scratches on 2/28/2023 was provided to C1’s parent, however, it did not note scratches to any other part of the body. It was also documented that C2’s parent was notified of the incident as well.

Regarding the allegations that AD handles daycare children in a rough manner, AD yells at daycare children and AD speaks inappropriately to daycare children, confidential interviews with former staff revealed that AD has been seen to yank children by their arms and/or pick them up and put them down roughly. Interviews with former staff also revealed AD has been heard to yell at children, however, no specific details of what AD has been heard to yell at children were provided. Interviews with former staff revealed they had not witnessed AD call or refer to a child as an expletive, however were told by someone else that AD had said that.

Interviews with current staff revealed AD has not been seen to grab, yank, or handle children in any rough way. Further interviews revealed AD does have a loud voice and is stern, however, AD has not been heard to yell at children in a belittling or inappropriate way or refer to children with expletives. Interviews with children additionally revealed AD does not yell at or grab children in a rough way. The interview with AD revealed AD does have a loud voice, however AD does not yell at children and AD denied calling any children names. AD also stated she does not grab or handle children in a rough manner, although AD stated she will quickly grab a child’s hand or arm if AD is able to prevent a child from hitting or hurting another child.

Based on conflicting statements, the allegations that C1 sustained unexplained injuries while in care, AD handles daycare children in a rough manner, AD yells at daycare children and AD speaks inappropriately to daycare children may have occurred, however is not supported or proven by evidence. Therefore, the above allegations are unsubstantiated. An exit interview was conducted and a copy of this report and appeal rights were discussed and provided to Owner Sally Chenoweth. A notice of site visit was also provided and must remain posted for 30 days.
